Thank you so much .. I was just trying to weigh the options. Your counsel was so kind.. I appreciate joo2018: No easy way out o. US and Canada share immigration data. It is not fully clear whether the data is shared for all applicants, but it is safe to assume so. What is certain is that marital status is one of the information shared.
I'm not sure he can escape the consequences of his decision as long as you are interested in Canada.
1. Married but unaccompanied For him to be attempting US green card without divorcing you, he must have presented himself as single in his original US visa application. If your application is scanned with US and they decide to go deeper, he might be caught out as having misrepresented his application. This will make your application a complex application and stall the processing. He may be found inadmissible for spousal sponsorship and may affect your own admissibility whether accompanying or not.(See here and here and here)
2. Divorce might be the only way to break his application from yours.
However, I do understand the need to preserve ones family. If you are still keen on immigrating, you may explore other countries: Australia, NZ and European countries. These countries don't have a tight immigration relationship with US like Canada. . |
