Foreveryours201: Yes I want to send off the appeal by this week. If I wait for Naric and Hubby's University I believe the 28 days would have lapsed, so I am intending to submit the degree cert and letter again and will mention that I am waiting for the NARIC Letter/Certificate and once it becomes available I will forward it on.
Would you mind forwarding on your appeal statement please? I will see if I still have a copy of my appeal. It wasn't actually technical at all, I didn't quote any cases. I just addressed the issues the ECO with supporting documents and added the ones I missed out earlier (letter from employer and extra payslips) I just stated that I have more documents which I believe will address his concerns and said I believe some documents were mistakenly overlooked, that's all. The good thing is that you just have to address ONLY the missing criteria, that's it, nothing extra. I got out a highlighter and marked every relevant thing on the documents, labelled everything clearly and sent it off. Once they reviewed it, they overturned the refusal without having to go further |

Foreveryours201: Ok. So do we appeal on EEA decision or Human Rights decision? these are the two options given on the appeal form.
With regards to Hubby's English language requirement, are we able to submit the degree cert again with letter from the University plus a certificate from NARIC?
As per my utility bills, council tax statement etc. Can I argue that it was submitted originally with the application but obviously not seen by the ECO and then add a letter from my tenancy manager?
Regarding documents regarding my stated income, what do you advise here? re submit again with the appeals form and then get another updated letter from my employer reiterating the information in the original documents submitted, plus confirming my salary again? Foreveryours, to be honest, I don't think it matters which grounds you want to appeal on. They make it sound like those are the only grounds of appeal by keeping it vague. When we appealed my wife's decision, I didn't even refer to any of those options. I just stated in the covering letter that I want to add some more supporting documents to address the ECO concerns referred to in the refusal letter. We also had the same issue of the ECO not seeing my wages on the bank statements (are they blind!) so I just used a highlighter and then attached the relevant payslips to the corresponding bank statements. 5 months later, their lawyer wrote her to say due to the additional information provided that they have overturned the ECO's decision. We paid just £80 for the appeal, can't believe it's almost £500 now. I think they want to discourage appeals but it's still your best bet but the waiting is a killer (6 months for us). You also have the flexibility of appealing a refused appeal without having to pay again. Like you said, another ECO can use another flimsy excuse to deny a fresh application meaning you're out double as they've now also raised the application fees. I think you have a strong case. |

Lexusgs430: I thought you were not meant to equate or quantify your very special wife financially. Is your wife not worth more than £600? Abeg, the money I saved, she's spent it on shopping already, anyway. Lol |

wallg123: Good Morning guys,
Please a quick question: Who has travelled with Air Maroc before?, Can they be recommended?. They seem to be the most pocket friendly Airline to LHR. .... If they not good let me stick with Lufthansa ............Your urgent advice is needed so i can book flight today..... Thanks Absolutely nothing wrong with Air Maroc, that's what I booked for my wife as it was £150 cheaper than the nearest quote from other airlines. It was a smooth trip with only 1.30hr stopover. No issues at all. Abeg I'm not paying £500-£600 for one way flight! |

abakilikiboy: Thanks Lexusgs430 I really really appreciate your support and response but are you saying the best option is to do the whole processing in Nigeria. It will be a bad idea to try to get her a visa to the UK, it will probably be rejected once they see your relationship and cause unnecessary problems to her settlement visa. Just get married in Nigeria, get everything ready and apply once and for all from Nigeria |

tosine: I have been following this forum for long and God bless the people responding to all questions. I plan to apply for my UK settlement visa in January. My wife meets all the requirements.
My question is for the supporting documents to Sheffield. Some of the documents like house agreement, wife pay slips are with my wife in the UK. While I have our pictures, phone logs and chats.
Do I send my own supporting docs to Sheffield and she sends her original docs too? Or do I request her to send it to me via email and I send as one to Sheffield? What's the best advice?
Thanks and God bless The easiest way is to send all the documents you have to your wife, then she will send everything together. DON'T EVER SEND TWO BATCHES, they won't accept the second one. |

Caribbeanwify28: Would it cause an issue that I created a new application and have a new GWF number issued? Or is it OK because I did not pay the visa fee? Carribeanwify, to be honest, you're almost there at the finish line. The fact that your application is still open and they're still waiting for the IHS payment after so many attempts to get in touch is quite amazing. Usually, by now they would have simply refused the visa and told you to appeal! Also, if you can use your MP to send the correct email address to speed up the process, please do so. Your lawyer is disgraceful, I hope you make a complaint to their trade body. |

Caribbeanwify28: Hi guys
Am I filling in something wrong on visa4uk. I just started a fresh application so that I can pay the IHS for my husband. When I got to the IHS section it said 0.00 USD and then just gave me an IHS reference. Why is it not asking me to pay I find it strange. Also it asks for details of the person you are joining or remaining with in the UK (thats me as my husband is in nigeria). It asks what is the visa expiry. well I don't have a visa. This system is not straight forward at all. There should be another way to just pay without creating new applications all the time. I understand your frustration because I went through when I was doing my wife's IHS after a successful appeal. We were also advised to go through the application and pay it which I did but when she submitted her passport they emailed her a different link to pay for the IHS! To avoid prolonging it I just paid and then applied for a refund of the first one. Due to the earlier problem with your husbands email address you don't have a unique link for the IHS payment which must have been in that email. If youre able to correct the email problem, get in touch through their contact form on Visa4uk and ask them to send you a link with the correct amount to pay. The IHS payment system is just a mess and very frustrating. |

TunzAntman: Hi Nairalanders, thanks for all the contribution on the thread. It's uber helpful and encouraging.
So I just want some opinion on my case.
Arrived in the uk on a visit visa in Jan 03 (I was 15 at the time)
Visa expired in Jan 05
Was living illegally (studying and working, I have a valid NI, tried to apply but was ill advised to wait for the 10 year route as I was over 18) till Jan 13 when I was stopped by police and taken to detention centre.
Applied for discretionary leave to remain in Jan 13 and was refused in May 13.
Appealed to the lower tribunal in 13 and refused in 2014.
Appealed to upper tribunal was refused in May 2015.
I was the detained when I went to sign on at Croydon HO in May 15 and taken to detention as I had exhausted my appeals.
I immediately requested for voluntary leave and was granted. I bought my ticket and left the UK in June 15.
Me and my partner of 6 years just got married and I am about to apply to join her.
Questions: Do you envisage any hiccups due to my immigration history?
Is it worth applying for priority service?
Do I need to mention my immigration history in my application?
Ps: no criminal records or cautions
Thank you guys! Dude, you're just going to waste money on priority. Yours is not a straightforward application. Like someone else pointed out, you'll be lucky to get it at the first try given your history. Just do your application, include ALL details, no half truths or obfuscation, include every document required (there's a comprehensive list on this forum) and wait for them to get touch. There's the EU right to family life which in all likelihood they will force you to invoke, so make sure to get in your application before we leave the EU! |

wallg123: @justwise @dday101 @Fifi123 please can you guys help me interpret this mail... ... I've done as instructed but am not sure the people at ukba abuja would agree to see me without me completing the application. I stopped the application after paying the IHS fee... Thank you for contacting UK Visas and Immigration international enquiry service. With regards to your query, please log in to your visa4uk account and create a new application, only complete as far as the IHS portal. Once you have paid the IHS please forward the new GWF reference number and IHS reference number along with the old GWF to the email address your were given. We hope this has answered your query. For any further details, or should you need to contact us again please refer to our website at https://ukvi-international.faq-help.com/, select appropriate country, click next and then select “E-Mail form” and complete as instructed. We will aim to come back to you within 1 day. That's the wrong advise, ignore that! They gave me that advice but when we submitted we were given another link to pay the IHS, meaning I paid twice and had to get the other refunded after like 8 weeks. Just submi all passport and documents and wait for the email with a special link to pay the IHS that will be associated with your GWF number. |
