TravelRe: U.S. Immigration Questions: Ask A U.S. Consular Officer by veecee29: 9:49am On Jan 05, 2015
Hi VO,
Pls i'm still waiting for your response on the questions below:

We did our traditional(customary) marriage on the 29th of March 2014 and we have a traditional marriage certificate to prove it.
We also did our registry marriage on the 29th of November 2014 which we also have a marriage certificate.
We intend petitioning for spousal visa come April. If we petition using the traditional marriage date,we will qualify for an IR1 visa by the time the visa will be ready. On the other hand,if we petition with the registry date,we will qualify for a CR1 visa. And we don't want a conditional visa after all these wait and given the financial implication of removal of condition.
My question is: Can we use our traditional marriage date and certificate to petition for I-130?Will the USCIS recognize the certificate?
Thanks in anticipation of ur response.

[quote author=VisaOfficer post=28157840]It's actually good in this case that the husband is still a Legal Permanent Residents. If he were a U.S. citizen, he would need to file a whole new petition for his child. IR1 and CR1 petitions don't allow derivatives.[/quote

Hi VO,please i need clarification on this particular response.
Is their no provision for the report of US citizen birth abroad? What i mean is that if i report to the embassy that my husband (the father of my baby)is a US citizen, won't the embassy give our child the US passport?Cos i wouldn't want to leave a baby behind when my visa clicks and after my wedding next year.

Hi VO,thanks for your response.I still need some clarification on d following:
Assuming he petitions as an LPR in December and then becomes a citizen in March,if after notifying USCIS and the case becomes current, does it mean that we have about three more months to wait given that the petition is three months old and that the wait time for spousal visa is six months?

Hi VO,
My husband is an LPR and we are hoping he will get his citizenship by March next year.My questions are:
1) Is it better to file for me as an LPR now or wait till he gets his citizenship in March?

2) If he files as an LPR and later gets his citizenship, how do we go about notifying USCIS about the change of status of the petitioner? And will this cause additional delay in the process or will it reduce our wait time to that of a US citizen petitioning for his spouse?
