Thanks for your response. I didn't stay for an extended period or overstay. And pls where on the form should I have indicated the need to extend my stay? Because the form doesn't give room for essays.

Be prepared for questions at the POE. Also, you should have confirmed on your DS-160 that you stayed for an extended period previously and intend to do the same on this trip.

Hello VO,
I renewed my visa for the 2nd time via dropbox. I am pregnant and at the time of renewal ,I studied the website and there was nowhere to state that I was pregnant on the application . My questions are:
1) Do I need to notify the embassy that I am pregnant in a seperate mail
2) or would telling them at the POE suffice and showing evidence that my bills would be paid?
P.S I had my 1st child in the U.S and all my bills were paid.

1. There are many reasons for denials and I really can't tell you, based on the information you've shared, how I think things would go in your case. We often issue non-immigrant visas to people with pending immigrant petitions, as long as we believe they will abide by the terms of the visa. Every case is different.

2. It's faster if your mother files for you.

3. Unfortunately, when a petitioner passes away, the petition is usually rendered invalid. There are a very few exceptions but none that would apply in this case. Here's hoping no one reading this ever has to confront that situation. If your mother and sister have the financial means, I suppose each of them could file an I-130 for you; that way, if, heaven forbid, one of the petitions become invalid, the other would still be active.

I don't know yet how this will play out. I'm hoping that wait times will be shortened. But, the wait times aren't just for Nigeria; they're worldwide. So the fact that Nigeria will no longer participate in the DV program may not have an effect upon priority dates.

The effect it will have: When NVC contacts me and says "We have 200 family-based cases if you can schedule them in November," I can say, "Yes, let's schedule them" instead of "I'm sorry, we're completely booked in November due to Diversity Visas." We'll be able to schedule more fiance cases every day, too! It's going to be awesome. smiley


Dearest VO, Thanks a lot for your responses so far. However I am about to ask a follow up question if u don't mind?.

1) I'm very concerned about the ten year wait period cos that's a long time plus the fear of my niv visa not being renewed pending the outcome of my petition.i know a couple of people that have been denied visas cos of a pending petition even though they had made previous us trips. What's the reason for d denial and how do I guard against it?

2) who would you advice to file for me, my mum or sister?

3) as much as we don't pray to lose loved ones, what happens if the petitioner dies in the process?

Thanks VO it really helped. I think she might as well go ahead and file. But 10yrs is a long time . Anyway I read in one of the replies u gave concerning the exclusion of nigeria from DV 2015 that the advantage is that the wait times for the other 2 categories i.e skilled professionals and reuniting family would be hastened. So are there chances that the 10yrs can be shortened.

1. Given that your mother is a U.S. citizen, as long as you do not have other ineligibilities (a criminal history or history of fraud, for instance), you should have no problem qualifying for an immigrant visa!
2. You'd be an F3. Right now the wait time for F3s is running around 10 years. The good news is you could travel with your spouse and children, though!
3. Sure, you can get a joint sponsor.
4. This is an interesting question and it can go either way. On one hand, clearly, you're an intending immigrant if there's an immigrant petition filed on your behalf. On the other hand, it sounds like you have a great travel history -- and if you were going to stay illegally in the U.S., you probably would already have done so. Personally, based solely on what you've written here, I would issue you a non-immigrant visa. It's certain that your current visa would NOT be cancelled just because your mother filed for you.

Hello Vo,
Please my question is this :
My mum is a us citizen and I currently travel to the u.s. And other countries for biz and pleasure. I would like to know:
1) what my chances are if she chooses to file for me
2) how long it would take if she files for me because I was already over 21 and married when she became a citizen
3) since she is not currently working in the u.s can I get my dads brother to sponsor my application
4) would the fact that she filed for me bar my future renewals or cancel my current visa.

I would please like answers so that I would know whether to just stay put in my home country and just always apply for u.s visas with my family to go on vacation grin
