Kenya Teaching Hospital ordered to pay woman $48,000 after her birth control failed

The judge said the private hospital in Nairobi had been negligent.

It's pay day for a woman in Kenya after a court ordered Aga Khan University Hospital to pay her $48,000 (about N9.5million) after she became pregnant despite having a contraceptive implant procedure.

The judge said the private hospital in Nairobi had been negligent and ordered the hospital to pay the mother $5,000 (N995,000) in damages and $43,000 (about 8.5 million) towards the cost of bringing up the child.

According to BBC, the woman said that she had the implant because she and her husband already had two children and did not want more, and was told that it would prevent her getting pregnant for three years.

The hospital is yet to make any comment, and according to the judge, despite being served court papers, no representative from the hospital appeared in court.

The woman who told the court that she became pregnant a year after the procedure, said the unplanned pregnancy caused her emotional pain, financial strain and marital problems, partly because her husband thought she had lied about seeking contraception.

May 29, 2015 marks a new beginning for Nigeria – as it transits power from the incumbent to the opposition party. After ruling for six years, President Goodluck Jonathan will handover to Muhammadu Buhari after losing out in the 2015 President elections.

After the transition takes place – all eyes are on Nigeria – will the West African nation finally become the ‘Super Power’ of Africa?

With monikers such as ‘The Giant of Africa’, it’s a bit disappointing to know Nigeria still does not rank as the number one country, despite being the most populous black nation in the world.

A number of factors have held the West African ‘giant’ from claiming a position it should have attained decades ago. With Buhari coming in as President (on his fourth attempt), many have enthused that in a matter of time, these problems can be solved – thereby leading the country to a new phase with many possibilities.

Economy Instability
With its declining welfare and social instability, Nigeria's huge economic potential has been marred by economic stagnation in its history. Despite abundant resources and coastal location, Nigeria has failed to grow and dominate Africa, only realising little of this potential.

The last few years have however seen rapid growth, much of which has been attributed to foreign investment, and credit has been given to Jonathan administration which has attempted to seize the opportunity. Nigeria’s economy became the largest in Africa (yes, bigger than South Africa’s).

But on the large scale – it has looked like the nation witnessed growth without development.

Buhari has the next four years to use the ‘budding’ economy, which has in the last few years set up itself, as Launchpad for something great. This will be a giant step

Security
One of the major setbacks in the Jonathan administration was insecurity. Boko Haram, the jihadist group based in north-eastern Nigeria, rose from a common radical group to a full blown militia with backing from ISIS in the last five years.

With Nigeria’s failure to nip the group’s activities at the bud years ago, Boko Haram has grown in numbers (about 7000 members) and now occupy 6,704 square miles in the country.

The Government’s inability to deal with this security threat was evidently shown with the abduction of over 200 schoolgirls in April 2014. Over a year later, the girls are yet to be rescued.

Many believe Buhari will fasten the eradication of Boko Haram – the retired Major-General’s experience as a Military leader looks like an advantage already.

“There is no doubt that in tackling the insurgency, we have a tough and urgent job to do”, Buhari said in his acceptance speech in April 2015.

“…with the cooperation of our neighbours; Cameroon, Niger, Chad and the international community and the commitment we are going to get from the military, it will take us a much shorter time to deal with them”, Buhari stated in a 2015 interview with the BBC.

Fuel Subsidy
The last days of the Jonathan administration have been marred with scarcity of petroleum products, especially Petrol and Diesel. Experts have described it as the worst fuel scarcity in years, lasting for close to a month.

Worse still, the scarcity has been reported to be an artificial creation of the oil marketers in attempts to force the Federal Government to pay subsidy debt allegedly owed them before a new administration is inaugurated on May 29, 2015.

While Jonathan remained silent on this, Buhari has been gathering data that will press forward a policy on the downstream sector of the petroleum industry, while his administration finds a solution to scarcity of products. He has already been making contacts with relevant stakeholders on how to effectively implement the subsidy regime.

Corruption
Many will enthuse that the last 6 years has stripped the country of its credibility in handling corruption allegations, with a hundred and one accusations levelled against the Jonathan administration.

A lack of integrity was seemingly established in 2013 when the then Central Bank Governor Sanusi Lamido Sanusi claimed that $20bn earning in oil could not be accounted for by the Nigerian National Petroleum Corporation (NNPC). The FG’s response to this was to have Sanusi replaced, citing the allegation as a case of ‘financial recklessness and misconduct’.

Another instance is the case of Buruji Kashamu – a member of Jonathan’s political party PDP (Peoples’ Democratic Party). Kashamu was recently elected as a Senator in Ogun State while a warrant for his arrest in the United States (for an alleged conspiracy to smuggle heroin) has been filed since 1998.

In the military coup of 1983, Buhari justified the military's seizure of power by chastising the then civilian government as ‘hopelessly corrupt’. Millions of Buhari supporters believe the 72-year-old will continue in this light as he resumes power this May.

Will the fangs of corruption be finally pulled out from Nigeria? A question many think has a positive answer.

Alexis Sanchez won two awards at the inaugural Facebook Football Awards which held yesterday


After losing a couple of Player of the awards to Chelsea hotshot, Eden Hazard, Alexis Sanchez's prolific debut season for Arsenal has finally been rewarded.

The Chilean forward won the Player of the Year award at the inaugural Facebook Football Awards.

He also won the Content of the Year award for his impressive dribbling skills in a pre-match warm-up at the Emirates Stadium.

Sanchez was however not present at the awards which held at the the Queen Elizabeth Olympic Park in London, and received his trophy presented by team-mate Alex Oxlade-Chamberlain via video.

The former Barcelona star while reflecting on his debut season for Arsenal revealed that his goal against Manchester City in September's 2-2 draw was his highlight of the season.

Tottenham sensation, Harry Kane won the Young Player of the Year Award, his second for this season after the PFA.

The 21-year-old said his winner against Arsenal in February's North London derby was his highlight of the season.

Rotimi Amaechi, yet again, threw a shade at the outgoing first lady, Patience Jonathan.

On Sunday, May 24, the Rivers State Governor, revealed that his disagreement with President Goodluck Jonathan, was partly caused by Patience Jonathan’s overt interference in matters that don’t concern her.

Ifeanyi Ubah's Capital Oil and Gas released a statement this evening saying it is releasing 13 million litres this night, which is about 400 trucks of petroleum products to ease the fuel scarcity that Nigeria is currently facing. They said they will release an additional 53 million litres in a few days. Read the statement below...

On Saturday 16th May 2015, we received an SMS ordering the suspension of loading activities in all depots from Monday 18th May 2015. We later realized that this directive was as a result of unpaid funds owed to transporters by oil marketers who in turn are owed by the Federal Government.

This development has resulted in immense hardship to our fellow country men and women. We believe that a better solution can be pursued towards solving this problem in a way that does not adversely affect our dear citizens. Capital Oil and Gas has watched with so much pain, the suffering and hardship our citizens have been subjected to as a result of scarcity of petrol, diesel, aviation fuel and house hold kerosene.

We are deeply pained to hear that hospitals cannot perform surgeries, laboratories are unable to carry out much needed tests especially for emergency patients leaving such patients at risk of dying, radio stations are shutting down, communication is being affected as MTN and other telecommunications company have announced an impending shut down while homes, offices and key facilities nationwide are experiencing blackouts. In some parts of the country, petrol is already selling at an all-time high of N1,000 per litre.

Our citizens have left their homes and are now sleeping in fuel stations,facing the risk of robbery attacks and other attendant risk. In a few days’ time, a new government headed by General Muhamadu Buhari will be sworn in. Apart from our citizens being unable to watch the handover on television and unavailability of transportation for attendees of this historic handover, the resulting chaos from this scarcity may shutdown the Nation and sabotage the efforts Nigeria has made to attain greater heights.

We are constrained at this point and have decided that two wrongs cannot make a right. We will not be part of this sabotage against our fatherland. Therefore from this minute, we shall take the risk of opening our facilities and commence swift loading and distribution of products Nationwide. Our facility has the capacity to load over 13 million litres of product before dawn.

This comes to approximately 400 trucks of petroleum products. With this act, it is our belief that once again our citizens will begin to smile, return to normal family and work life. We call on other petroleum marketers to follow suit and save our Nation from this impending economic and social crisis. This is a period that requires patriotism and service to fatherland. Let’s join hands to help our fellow citizens and save Nigeria. We also call on striking bodies to call off the strike action. Let us work together for the betterment of our people. As we brief you this moment, our truck park, port reception facilities and our depot complex have been ordered opened.

We are ordering and resuming discharge of products from vessels at our berths. We have ordered our trucks to commence loading of products and move overnight to every state of the Federation. Most importantly, we wish to use this medium to thank NNPC and PPMC for their steadfastness in ensuring the availability of petroleum products. Current PPMC stock level in our storage tanks and buffer stock on vessels awaiting discharge at our jetty is capable of meeting the Nation’s need for 15 days. Furthermore, we wish to emphasis that we have a total solution to the traffic menace on the oshodi apapaexpressway.

In the coming weeks, we hope to engage the Federal Government (Federal Ministry of Transport), Lagos State Government and other stakeholders in the affected area, to optimally utilize our truck park facilities which has the capacity to accommodate over 1,100 trucks per time and 5,000 on a shift basis. Capital Oil and Gas continues to appeal to Nigerians to accept and support deregulation as this will curb corruption, enhance competition, lead to reduction of pump price for petroleum products and ensure constant supply to meet Nigeria’s demand. Long live the Federal Republic of Nigeria.
