A Rivers State High Court presided over by Justice Letam Nyordee had on Tuesday ordered that the detained leader of the Rivers State House of Assembly, Hon. Chidi Julius Lloyd, be remanded in prison custody pending the ruling on his bail application today.

Lead counsel to Lloyd, Mr. Beluolisa Nwofor, SAN, moved for bail application shortly after the lawmaker pleaded not guilty to all six charges preferred against him by the police.

The charges include “attempted murder, intent to maim, disfigure and injure unlawful grievous harm and wilfully destroying government property on July 9, 2013 at the Rivers State House of Assembly contrary to sections 324, 320, 312, 305, 351 and 355 of the Criminal Code Law, 1999 and the Rivers State Criminal Procedure Law, Cap 37 laws of Rivers State, 1999.”

Nwofor submitted that the motion was brought “pursuant to section 118, sub 124 of the Criminal Procedure Law of Rivers State Cap 37, Sections 33, 34 sub 1(a), 35(1)(4), 36 sub 6, 39 rule 1(2) and 41 sub 1 of the 1999 Constitution, and Article 4, 5, 6, 12, sub 1(2) and 16 sub 1 of the African Charter on Human and Peoples Rights Act Cap A9 Vol. 1 Laws of Nigeria, 2004.”

Nwofor prayed the court to discountenance the counter-affidavit filed by the police on the bail application, maintaining that pursuant to section 36, sub-section 5 of the Criminal Law, a person is deemed innocent until a competent court of law decides otherwise.

He therefore, prayed the court to grant Lloyd bail on self-recognition, since the accused wilfully turned in himself to the police since July 26, and that considering the status of the accused, he will turn himself in for further trials.

Responding, the Attorney-General of Rivers State, Mr. Nworgu Boms who had earlier taken over the matter after Lloyd was arraigned, applied to withdraw the counter-affidavit filed by Police, saying they were ready to go on with the trial of the matter.

The Military Police on Thursday said it arrested 28 soldiers on the streets of Lagos.

Maj. Oyegoke Badamosi, spokesman for the 9 Brigade, Nigerian Army, Ikeja Cantonment, who made this known to the News Agency of Nigeria (NAN) in Lagos, said the soldiers were arrested by the military police attached to “Operation Checkmate”, to curb misconduct and unauthorized movement of personnel in the city.

He added that the operation was also aimed at checkmating abandonment of duty post by some soldiers.

He, however, said those arrested had been released after confirmation from their offices that they were personnel on genuine assignment.

Badamosi said that the operation would be a daily routine and would be extended to other parts of the state to enable the military authority to continue to enforce armed forces rules on erring personnel. (NAN)
