REFUSAL STATEMENT I note that you have previously traveled to the United Kingdom, and with you earlier application provided full details to satisfy the Entry Clearance Officer at that time that you had met the requirements of the immigration rules as a visitor: however each case must be decided on its individual merits at the time of application. On your previous application for a visitor visa, you stated on your application form that you intended to travel to the UK for 3 weeks. During your visit to the UK you stayed for a total of 22 weeks, approximately 19 weeks longer than you had indicated in your application. Your personal and financial circumstances were considered sufficient to support a visit of 3 weeks. In assessing this application I have taken into account the extended duration of this visit and your current personal and financial circumstances. You have stated on your application that you are traveling to the UK for a period of two weeks for a holiday. You have stated that you are employed in Nigeria by …. Hospital With a total monthly income of 400 pounds. You have stated the personal cost to yourself of your proposed visit to the UK is 1900 pounds. In support of your application you have submitted a letter from your employer, payslips and bank statements in your own name. I note from the letter submitted from ….. hospital that you are employed on a short term basis for the period 02/12/13- 31/1/14 on a salary of 100000 (377.36 WWW.OANDA.COM 09/01/14) per month. You have not indicated that any further employment opportunities are available to you after 31/1/14 and I note you have stated that you hold no assets, savings or investments in Nigeria or elsewhere. Given that prior to your proposed holiday your employment will cease, I am not satisfied that it is credible that you would make a financial outlay of 1900 pounds, the equivalent of over 5months of your current salary, on a two week tourist visit to the Uk when you have no savings, assets or income to return to in your country of residence. I am also not satisfied that the transaction history in the bank statement you have submitted corroborates the statements made on your application form. I note that whilst your salary is regularly credited to the account, the balance of this account has been significantly inflated by a large deposit of 500,000 (1886.84) paid into the account the week prior to your application. This is indicative of an account being artificially inflated for the purposes of obtaining an entry clearance. You have not provided any evidence as to the origin of this recent deposit and I note you have not declared receiving any further income other than your salary. In the absence of evidence of the origin of these funds and the discrepancies on your statement I am not satisfied that these funds are genuinely available for your use or that your financial circumstances are as stated. I note that you have stated that you are single and you have not indicated having any dependents resident with you in Nigeria. In the absence of evidence of any assets or savings you may have or employment to return to in Nigeria. I am not satisfied that you have demonstrated sufficient social, family or economic ties to Nigeria. I am not satisfied that you have established that the reasons or intentions for this visit are as claimed. On the evidence before me on the balance of probabilities, I am not satisfied that you are genuinely seeking entry as a visitor for a limited period as stated by you, not exceeding 6months,nor am I satisfied that you intend to leave the united kingdom at the end of the period of the visit as stated by you. 41(i)(ii) I have therefore refused your application because I am not satisfied, on the balance of probabilities that you meet all of the requirements of the relevant paragraph of the United Kingdom immigration rules. Your right of appeal is limited to the grounds referred to in section 84(1)(c) of the nationality, immigration and asylum act 2002. PLEASE ADVICE! HOW DO I RESPOND TO THIS REASONS IN MY FRESH APPLICATION |

Rihannaola: I feel like I have corrected most of my mistakes from d past application especially the money lodgement and employment parts. I just need to find a way to explain my 5 months stay in d uk without sounding dishonest. |

justwise: Justwise, I am just trying to get it right this time around. I feel like staying for 5months wouldn't have been an issue if not for my money lodgement issue and not submitting a 'proper' employment letter. So I worry that explaining d reasons for my rejection d last time will make dis application cumbersome. But if u all say it is ideal thing, I will do just that and hope for d best. UK visas had always been easy for me.. Until dis rejection I guess that why I am so worried. |

justwise: I was a student when I applied for d visa, but I had just graduated. I stated I would spend 3weeks with a family friend. So when I travelled in Feb 2012 I wrote d first part of d exam, and d original plan was to return to Nigeria and then go back. But becos I had free accommodation and with d advice of family, I stayed back to study over dere for d next exam which was 4months later. I didn't feel like I was breaking any law, becos I wasn't working and didn't seek medical care. I have friends that have stayed up to 5months in the past and still got a visa renewal even 5years visas. |

justwise: I am still trying to find something. Looking through my emails and old documents. Modified: After typing the earlier statement, I got an inspiration to check my other email. Evidences have been found. Now I can use it. BUT I worry that I would come across as being dishonest in the first place?? Don't u guys think so? Does the ECO forgive |

justwise: Justwise, the reason I stayed in the UK for 5months was to write an American board exam not available in Nigeria. Unfortunately I don't have a copy of my scheduling permit as proof. What should I do? Should I go ahead and state this seemingly unconvincing reason in my new application? |

Rihannaola: Thanks for d advice. I will try and get a pay slip from my difficult boss that should be a better explanation I guess? Then for d cash deposit, I will do my best to explain and hope dey believe me. |

Hello everyone, I am applying for a business visitor visa soon to enable me take d PLAB 2 examination for doctors. As a student in a foreign country, I had gotten multiple 2 year UK visas that allowed me visit the UK during my holidays. I didn't consider the technicalities of getting a UK VISA to be such a big deal until 2014. When I applied for a UK visa in Nigeria as a worker. I must admit I made so many mistakes...From money lodgement, to not providing a salary account statement and also spending 5months in the UK during my last visit. OF COURSE I WAS REJECTED. Now I am pursuing a career defining opportunity in the UK and I would like to ask a few questions... 1. Should I defend/explain why I stayed in the UK for 5months and also the money lodgement in my new application or totally ignore it and treat dis application as an independent entity? 2. I have been rejected visit visas to the Usa and Canada, should I include their rejection paper/letter as part of the documents? 3. I work in a private hospital, and my boss doesn't pay my salary till d middle of the next month and not on any specific day. Should I explain that 'irregularity' to the ECO? 4. I received some cash payments for a LEGAL business deal totalling 600k about 4months ago which I paid into my salary account. Should I explain this to the ECO considering I have no documents to back my explanation. ****my closing balance excluding that 600k is still around 2.2m more than enough for my 8 day trip. GOD BLESS U AS U HELP ME |
