The Court of Appeal, Abuja, on Wednesday, turned down the request of the Labour Party’s Presidential candidate, Mr Peter Gregory Obi seeking to stop the Independent National Electoral Commission, INEC, from reconfiguring the BVAS equipment used for the conduct of the February 25 Presidential election.

The Court held that granting the request would jeopardize the electoral body in the conduct of the March 11 governorship and State Houses of Assembly elections.

The Court agreed with INEC that information on accreditation contained in the BVAS devices had been uploaded into its back up server and could be accessed at any time.

The Appellate Court predicated its agreement with INEC on the ground that all averments in the counter affidavit of the Electoral body were not challenged.

THE Independent National Electoral Commission, INEC, has approached the Court of Appeal in Abuja, praying it to vary the orders it granted the presidential candidates of the Labour Party, LP, and Peoples Democratic Party, PDP, to be allowed to inspect sensitive materials that were used for the presidential election.

INEC, in its legal process dated March 4, urged the appellate court, which will sit as the Presidential Election Petition Tribunal, to vary the order to enable it to reconfigure the Bimodal Voter Accreditation System, BVAS, it used for the presidential poll on February 25.

The Labor Party said it had engaged the services of at least 20 senior advocates of Nigeria to challenge the outcome of the February 25 presidential election on behalf of its presidential candidate, Peter Obi.

According to sources within the party, the lawyers drawn from different chambers were being furnished with materials that would be used as evidence in court.The president-elect and candidate of the All Progressives Congress, Bola Tinubu, was announced the winner of the keenly contested election last Wednesday.

Tinubu polled 8,794,726 votes to defeat the Peoples Democratic Party candidate, Atiku Abubakar, and the LP flag bearer, who got 6,984,520 and 6,101,533 votes respectively.

The Supreme Court on Friday ordered that old N200, N500, and N1,000 notes remain in circulation till December 31, 2023.

The apex court also nullified the Federal Government’s naira redesign policy, declaring it as an affront to the 1999 Constitution.

Justice Emmanuel Agim, who read the lead judgement, held that the preliminary objections by the defendants (the Attorney General of the Federation, Bayelsa and Edo states) are dismissed as the court has the jurisdiction to entertain the suit.

Citing Section 23(2)1 of the constitution, the court held that the dispute between the Federal Government and states must involve law or facts.

The apex court further held that President Muhammadu Buhari in his broadcast admitted that the policy is flawed with a lot of challenges.

The electoral commission, INEC, has declared Bola Tinubu, the candidate of Nigeria’s ruling party, APC, as the winner of Saturday’s presidential election.

Mr Tinubu defeated 17 other candidates who took part in the election. He scored a total of 8,794,726 votes, the highest of all the candidates, thus meeting the first constitutional requirement to be declared the winner.

He also scored over 25 per cent of the votes cast in 30 states, more than the 24 states constitutionally required.

Feb 23 (Reuters) – U.S. President Joe Biden called on Thursday for Nigeria’s imminent presidential election to be peaceful and transparent, urging candidates and parties to accept the results as announced by the country’s electoral commission.

More than 93 million Nigerians, out of a total population of over 200 million, are registered to vote in Saturday’s presidential and parliamentary election, seen as the most wide open since the country returned to democracy in 1999.

“I commend yesterday’s peace accord in Nigeria,” Biden said in a statement, referring to a pledge signed by all candidates on Wednesday to seek redress through the courts for any grievances.

The African Union election observation mission (AUEOM) has published its preliminary report on the presidential and National Assembly elections that were conducted in Nigeria last Saturday.

The mission, in its report released on Monday, expressed concern over the delay in commencement of voting in 83% of the polling units it monitored.

“The average delay was over an hour. In some cases, they opened as late as 11:00 am. This was largely due to the late arrival of polling officials and materials and the slow set-up of the polling units,” the statement reads.

Former President Olusegun Obasanjo has asked that results from polling units where the Bimodal Voter Accreditation System (BVAS) was not used should be nullified.

The International Republican Institute (IRI) and National Democratic Institute (NDI) Joint Election Observation Mission (IEOM) have presented their preliminary statement on the Presidential and National Assembly elections in Nigeria.
