The Court of Appeal, Abuja, on Wednesday, turned down the request of the Labour Party’s Presidential candidate, Mr Peter Gregory Obi seeking to stop the Independent National Electoral Commission, INEC, from reconfiguring the BVAS equipment used for the conduct of the February 25 Presidential election. The Court held that granting the request would jeopardize the electoral body in the conduct of the March 11 governorship and State Houses of Assembly elections. The Court agreed with INEC that information on accreditation contained in the BVAS devices had been uploaded into its back up server and could be accessed at any time. The Appellate Court predicated its agreement with INEC on the ground that all averments in the counter affidavit of the Electoral body were not challenged. THE Independent National Electoral Commission, INEC, has approached the Court of Appeal in Abuja, praying it to vary the orders it granted the presidential candidates of the Labour Party, LP, and Peoples Democratic Party, PDP, to be allowed to inspect sensitive materials that were used for the presidential election. INEC, in its legal process dated March 4, urged the appellate court, which will sit as the Presidential Election Petition Tribunal, to vary the order to enable it to reconfigure the Bimodal Voter Accreditation System, BVAS, it used for the presidential poll on February 25. The Labor Party said it had engaged the services of at least 20 senior advocates of Nigeria to challenge the outcome of the February 25 presidential election on behalf of its presidential candidate, Peter Obi. The Supreme Court on Friday ordered that old N200, N500, and N1,000 notes remain in circulation till December 31, 2023. The apex court also nullified the Federal Government’s naira redesign policy, declaring it as an affront to the 1999 Constitution. Justice Emmanuel Agim, who read the lead judgement, held that the preliminary objections by the defendants (the Attorney General of the Federation, Bayelsa and Edo states) are dismissed as the court has the jurisdiction to entertain the suit. Citing Section 23(2)1 of the constitution, the court held that the dispute between the Federal Government and states must involve law or facts. The electoral commission, INEC, has declared Bola Tinubu, the candidate of Nigeria’s ruling party, APC, as the winner of Saturday’s presidential election. Mr Tinubu defeated 17 other candidates who took part in the election. He scored a total of 8,794,726 votes, the highest of all the candidates, thus meeting the first constitutional requirement to be declared the winner. The African Union election observation mission (AUEOM) has published its preliminary report on the presidential and National Assembly elections that were conducted in Nigeria last Saturday. The mission, in its report released on Monday, expressed concern over the delay in commencement of voting in 83% of the polling units it monitored. “The average delay was over an hour. In some cases, they opened as late as 11:00 am. This was largely due to the late arrival of polling officials and materials and the slow set-up of the polling units,” the statement reads.
