am a big fan of nokia phones but my experience with windows phone have been frustrating. I got a lumia 920, for almost a year I cant upgrade to window 8.1 even with 12G data on my phone. Took it to nokia care and was told am out of warranty and must therefore pay 6k for upgrade, I left them out of anger. Am using nokia x200 now, i use the lumia ONLY to take pictures.

If your phone is locked to a particular network, you'll have to request for an unlock code from the network carrier. Also computer village guyz know how to go about it. Care center don't do that.

If there is no mechanical damage or liquid intrusion that might hamper the functions of your phone, your last option would be firmware tweaking/ upgrade which can only be done in care center.

If its the menu button it might be a touch problem but if its just a particular function on the screen it recommend firmware update. Its high time you upgrade to W8.1

I'll advise you should be patient with your phone repair as spares are not yet available in Nokia care (but anytime soon), any spare you're offered might be fake.

Your phone is Lumia 535, the 1090 you wrote here is the RM number. You can repair the phone free @ Nokia Care on first mechanical damage under warranty by Mansard.

I'll advice you check your network connection and the signal strength anytime you want to download. Also free up enough memory to accommodate your new files. Your last option could be to restore the factory settings.
