1) Flynn spoke with Kislyak multiple times apparently forgetting that the FBI counter-intelligence office monitors such calls;
2) Flynn conducted foreign policy as a private citizen; "During the Dec. 29 call with Kislyak, the pair discussed sanctions at length, despite Flynn’s denials later." By the way the ISIS situation in Syria was also discussed, Egypt was also mentioned.
3) And Kisylak argued that the Obama administration sanctions were aimed at damaging the incoming Trump administration just as much as they were the Kremlin."
4) When asked about it, Flynn lied to the FBI and to Pence all without wondering why the FBI was asking him those questions and all without considering that they might have been listening.
5) The lie to Pence got Flynn fired. The lie to the FBI got him prosecuted. And he pleaded guilty in open court. Twice. Under oath.
