**the Lawmakers from the Katsina State’s CPC that benefited from the fraud must vacate their seat immediately. - Judge.

A Federal High Court on Friday in Abuja nullified the Certificate of Return issued to 10 lawmakers on the platform of the Congress for Progressive Change (CPC) representing Katsina State in the National Assembly.

Justice Gladys Olotu, while delivering judgment, held that the lawmakers must vacate the seats to pave way for the winners of the 2011 National Assembly elections from the state.

Olotu said that INEC lacked the powers under Sections 68 (1) and 75 (1) of the Electoral Act to withdraw any certificate of return from candidates who validly won an election.

The Senators along with eight members of the House of Representatives from the Katsina State’s CPC that benefited from the fraud must vacate their seat immediately.

NAN further reports that the plaintiffs, who are to benefit from the judgment, are Abdu Yandoma and Ahmad Sani, who contested the Katsina North and Katsina Central Senatorial Districts’ elections respectively.

The rest are Murtala Isa, Muntari Dandutse, Musa Salisu, Aminu Ashiru, Umar Katsayal, Muhammad Tukur, Tasi’u Doguro, and Abdu Dankama.

"INEC lacks the powers to cancel, nullify, review, withdraw, void, and invalidate either directly or indirectly, the certificates of return validly issued to the Plaintiffs consequent upon their winning the election.

"The plaintiffs, who were the candidates that contested and won the April 9, 2011 National Assembly elections, were duly issued certificates of return by INEC within the stipulated seven days allowed by law.

"Evidence before the court shows that INEC’s Returning Officer in the elections purportedly withdrew the certificate of returns and issued fresh ones to people who did not contest the elections.

"INEC acted illegally by withdrawing the certificates of return and going on to issue fresh ones to those that did not contest elections,’’ she said.

The plaintiffs had asked the court to nullify the certificates of return INEC issued to the defendants and order that the lawmakers vacate their seats in the National Assembly.

Buhari can not even control CPC leadas in his own state; till this day, Katsina still hv 2 different sets of contestants battling it out (governorship, legislative etc) b4 his very nose! Thought the argument has also bn he was a 'disciplined' and 'strong' leada?..... And CPC still believes it won last yr's general election

And about who has power or not, INEC as an electoral body was formed by the govt. and given all the necessary powers to function. So why not let it function so?

We know PDP shocased some forms of electoral malpractises during the 2011 general elections,that does not mean CPC did not rigg.-in some places they rigged their way through.

A Federal High Court in Abuja, Friday, held that the Independent National Electoral Commission, INEC, lacks the constitutional powers to withdraw Certificate of Return issued to any person affirmed as the winner of an electoral contest by its returning officer.

Justice Gladys Olotu who made the declaration while delivering judgment in a suit that was filed before the high court by a faction of the Congress for Progressive Change, CPC, in Katsina state challenging the withdrawal of their Certificates of Return by INEC, maintained that going by Section 68(1) and 75(1) of the Electoral Act 2010, the electoral body cannot reverse its action when a Certificate of Return is issued to a winner of an election, without an order of a tribunal or a competent court of jurisdiction.

The judge held that INEC acted ultra-vires its powers by withdrawing the certificates of return issued two CPC Senators and eight members of the House of Representatives in Katsina State and subsequently re-issued fresh ones to other candidates.

Specifically, the plaintiffs had prayed the court to nullify the Certificates of Return that INEC issued to Senator Abubakar Sadiq Yar’adua, Senator Abubakar Hadi Sirika and eight other members of the House of Representatives, as well as, order that the lawmakers vacate their seats in the National Assembly forthwith.

sometimes, person go confuse more and more. This is one of the parties that has agreed to merge to form bigger one that can give deadly blow to pdp. That is why merger is not the issue here. What is necessary here to pray for free and fair elections and come out and vote wisely. By that, better candidate will eventual be voted into power gradually. A particular candidate can be good or fair, but majority of nigerians are VERY stupid and useless, therefore will want to support rigging.

If Buhari had waded in to have it his own way confused human being would have called him a Dictator and called CPC a one man's party, now that he allowed the court the decide the case based on the law of the land which is what democracy entails you are still talking rubbish...
