It is only declared during natural and man made disater such as earthquake or terrorist attack.

The SOE law depends on the constitution of the country i.e it varies from country to country.

It overrides certain human rights and freedom like freedom of movement. This depend on the law that limit the power that may be invoked by the SOE. However non derogable rights like right to life must always be honoured.

Functions of executive, legislative and judiciary power may also be suspended which includes indefinite suspension of a governor but this depends on the constitutional law guiding SOE in the nation.

In dictatorial regime like the military regime and to some extent democracy. SOE can be used to surpress citizen rights by extending it indefinetly and introducing martial law.

The government also have direct authority over any citizen property necessary for meeting the SOE's aim.
