Nigeria election is free but not fair or credible-Ifeduba

Unless some constitutional flaws are remove from the Nigeria 1999 constitution as amended we can have a free but never a fair nor credible elections.

Every Dick and Harry who can afford Nomination/ Expression of Interest fee is free and welcome to contest election but will the election be Fair to all? No! Will the election be credible? NO!

Why? Because the constitution ridicles Nigeria electoral system

According to the 1999 constitution as amended of the Federal Republic of Nigeria- Third Schedule, Part 1 (F)
Section 14 (1) " The Independent National Electoral Commission shall comprise the Following members
(a) a chairman, who shall be the chief electoral commissioner and
(b) twelve other members to be known as National electoral commissioners, who shall be persons of unquestionably intergrity and not less than fifty years and forty years of age, respectively"

THE GREAT FLAW

section 14 subsection 2 states
" There shall be for each state of the Federation and the federal capital Territory , Abuja, A resident Electoral commissioner who shall

A- BE APPOINTED BY THE PRESIDENT
B- be Persons of unquestionable intergrity:

“Section 14(2) of Part 1 of the Third Schedule to the 1999 Constitution empowers a sitting President ( Goodluck Jonathan of the PDP) to appoint Resident Electoral Commissioners(RECs) ,
“Although the Constitution says those to be appointed must be persons of unquestionable integrity, it is clear that some of them are actually card-carrying members of political parties. Some of them got the appointment on the basis of loyalty to parties.
“By virtue of their appointment, it is difficult to prevent key decisions from leaking to their parties.

“Another issue related to this borders on the need to make the Chairman of INEC the Chief Executive Officer and Accounting Officer of the Commission.”

it is improper to make INEC chairman CEO and the Secretary to the Accounting Officer.
INEC chairman ought to be the CEO and accounting officer of the commission.

“Though the chairman of the Commission is the CEO, he is also not the Accounting Officer. Several key heads of functions may therefore not report directly to the INEC chairman who in the eyes of the public takes direct responsibility over the affairs of the commission.

“In a situation where the Accounting Officer is weak, the operations of the Commission are likely to be affected negatively since the heads of the key functions do not report directly to the INEC chairman.

The INEC chairman must be more powerful than the President for a fair and credible election to take place.
