If something is illegal, that necessarily means that there IS a law prohibiting the conduct. And of course, such law will have a punitive measure because it's PENAL law. The goal is to discourage such behavior via punishment.

Who gives the punishment? It depends on whether the jurisdiction observes trial by jury, and whether the accused opts for that in lieu of a bench trial.
