Patent War: Apple Won’t Be Getting $930 Million From Samsung Anymore by Ping411: 8:55pm On May 19, 2015
A U.S. appeals court has reversed part of the $930 million verdict Apple won in 2012 against Samsung. The new ruling effectively means Apple will not receive some monetary damages tied to the look and presentation of Samsung devices.

The U.S. Federal Circuit Court of Appeals reviewed the jury’s August 2012 finding, which stated Samsung had violated Apple patents or trademarks in 23 devices, including its Galaxy S II smartphones.

But on Monday, the court deviated from the jury’s finding regarding trade dress protections, a series of laws focused on protecting a product’s unique looks and packaging.

In this case, the court said the features Apple accused Samsung of emulating — the shape and screen appearance of older iPhones, for example — should not be included in the verdict because those features are fundamental to the way smartphones operate. By giving Apple this level of protection, the court would effectively give Apple a monopoly on such basic features.

Monday’s reversal on trade dress protections means Apple could pocket about $548 million in damages versus $930 million.

The original trial between Apple and Samsung was a widely watched event and is occasionally referred to as “the great smartphone war.”

Over the course of the past several years, Samsung has quickly risen to prominence, becoming one of the largest global smartphone makers; it released a slew of new smartphones and tablets at a faster rate than even Apple. In fact, the marketing research firm IDC reported Samsung eclipsed Apple in 2012 for market share of so-called “smart connected devices,” a market that includes smartphones, tablets as well as desktop and laptop computers.

Samsung and Apple have been locked head-to-head in a contentious battle for smartphone domination for years, though last month Samsung reclaimed the title of “largest smartphone maker” after shipping more smartphones worldwide than Apple during the first quarter of 2015, according to market researcher Strategy Analytics.
