As the police service been intimated by a petition to dismiss him being a prerequisite to an order of mandamus? Ur legal reasoning is serious. Then, u might not even be a lawyer.

Only the president can remove him without even batting an eyelid and he mbu knows it.even the police IG can be removed at the snap of a finger if the C in C so desires.so mbu remaining as an AIG is soley in the hand of the president.it is not in the hand of any court or anywhere else.mbu himself knows the tide can swing anywhere either in his favor or against him,i can assure you now the person he will be seeking to please is the president as his rank is a political position.
One thing mbu has against him is that amechi who happens to be very close to the president right now is not happy with him,it is now left to see if amechi can convince the president to remove him.
You need to understand how the police politics work for you to understand what it is at play here,mbu as a smart officer will have making serious overtures and apologises to amechi and the top guys he might have offended in the apc.

well i have no read the briefs. I am only stating my argument based on the declaration of the court which seems absurd to me. The court can always redirect them on the procedures to follow rather than just make a vague declaration as if to say a court is powerless in such matters.

Ask itself this simple question:
1. Is that the prayer of the plaintiff? The court is not a father Christmas and will not give what was not asked. Order of mandamus is not consequential here.
2. Can the court make an order against a party not joined in the suit? The plaintiff never made the Police Service Commission a party to the suit to warrant an order made against it. Its an affront to justice to make an order.
3. Ur example of a student in a university and a serving senior police officer are parallel. The student doesn't have a contract with the university but Mbu has a contract with the police.
4. Are yu a lawyer? If no, accept my above suggestions because am one!
