The International Criminal Court And Its Lust For African Leaders by Sanchez01: 6:20pm On Jun 17, 2015
The week begins with news of the failed arrest of the President of Sudan while he was attending the AU Summit held in Sandton, Johannesburg South Africa.

Omar al-Bashir has been linked to war crimes in his homeland of Sudan and is said to be responsible for the loss of hundreds of thousands of lives. The International Criminal Court, which is an EU funded and EU-led legal entity, instructed the South African government to ensure that Omar al-Bashir does not leave the country during his brief visit over the weekend of the 13th and 14 of June 2015.

The North Gauteng High Court granted an order for the arrest of Omar al-Bashir while he was in South Africa but the authorities failed to arrest him and he is said to have flown out of the country on the morning of Monday the 15th of June 2015.

This recent development raises many questions about the relevance of the International Criminal Court. One question is if it has been established for the sole purpose of targeting African leaders. It is a well known fact that a great number of African States who are signatories to the ICC are expected to give their cooperation in return for aid and trade advantages.

Sudan is known to have foregone Billions of Dollars in aid as it does not cooperate with the ICC.

South Africa is also a signatory to the ICC and failing to arrest al-Bashir could have far reaching effects for this young African democracy. Reports that South African troops deployed in Khartoum, Sudan have been held hostage have been rubbished by the South African National Defense Force.

On the other hand, Rubert Mugade has come out in defense of the decision by the South African government not to arrest al-Bashir and even lashed out at the ICC. He has been quoted as saying that the ICC is not welcome on the African continent.

“This is not the headquarters of the ICC; we don’t want it in this region at all,”

— Zimbabwean President, Robert Mugabe (At the African Summit)

The coming weeks and months will reveal what this recent failed attempt to arrest al-Bashir means for the sovereignty of African governments and the autonomy of the African Union. It will also come be to be seen just how the ICC under the control of the European Union, a powerful economic bloc, will react to the lack of cooperation shown by the South African government.
