Rivers: Court denies LG chairmen preservative order A Federal High Court in Port Harcourt, Rivers State, yesterday refused to grant a preservative order to stop the new chairmen from being dissolved, while the matter was still in court. Justice Hassan Quadri gave the order following an application by counsel to the 22 chairmen to grant an order to protect them from being dissolved by the state government. Justice Quadri also gave the order following the absence of a counsel to the House of Assembly, who was also a party in the matter, adding that it was necessary to give room for fair hearing. Solicitor-General of the state, Rufus Godwins, who represented the state government and Attorney-General, Emmanuel Aguma, in the matter, had argued that Aguma, who had just been sworn-in as Commissioner for Justice, deserved some time to prepare the state government for the matter. Godwins, who is also Permanent Secretary in the Ministry of Justice, prayed the court for a short adjournment, stressing that there was no need for the court to be in a hurry to hear the motion, since the matter was appearing in court for the first time. Counsel to the council chairmen, Adebayo Owonikoko, a Senior Advocate of Nigeria, SAN, appealed to the court to grant an interim preservative order to protect the chairmen from being dissolved. Owonikoko explained that the council bosses needed to be protected, while the matter was still in court. Speaking to newsmen shortly after the sitting, the Solicitor-General, Mr. Godwins, said the order of the court was justified, especially as his argument was considered for adjournment. Also, Counsel to the chairmen, Owonikoko, said all the parties were not expected to take any action on the matter that would undermine what was before the court. The matter was adjourned till June 24 for hearing on motion. The 22 newly elected chairmen had gone to court to challenge the power of the state governor, Nyesom Wike, to remove them from office. -National Mirror |

I wonder what ameachi wanted to achieve by holding council election few days to the end of his tenure... Illegality can not stand in the eye of the law... |

How ironic, APC wants a preservative order from the court when in the last 2yrs as the party in power they failed woefully to preserve the integrity of the court, the judges, lawyers and litigants. Since the return of civil rule, Amaechi is one of the biggest beneficiaries of our judicial process and I dare say no one has also done more to bring our judiciary into disrepute like the clown from Ubima. APC in Rivers state should be ashamed of themselves for trying to use the instrumentality of the law to preserve their dubious status when they've denied thousands of innocent Rivers indigines that same right for at least 2yrs 4 Likes |

chadnezzar0worl: Amaechi's policies? Is keeping d judiciary paralyzed for 1yr+ a policy to be preserved? Or keeping d State Assembly complex under lock? LG elections were not conducted in Rivers State almost throughout Amaechi's tenure yet barely a wk to d end of his tenure he conducts elections that only a handful of people participated in. Even the money appropriated for that purpose has been called into question...and u regard that as a policy to be preserved? Is it not a shame that Amaechi ensured that there was no Chief Judge or President of d Customary Court of Appeal? Even a simple assignment as this one he bungled and that should be maintained? You should talk when he starts knocking down schools, excavating constructed roads and so on and even then u must be sure that those weren't death traps left behind in the name of Amaechi's policies. Take it or leave it, Rivers State is a PDP state just as Lagos is APC. It is completely odd for APC to clear 22 out of 23 LGAs at grassroot level so such glaring illegality mist be brought down! |
