HERE ARE 5 INVALUABLE PIECES OF INFORMATION YOU NEED.


1. YOUR LANDLORD MUST GIVE YOU A (WRITTEN) NOTICE TO QUIT:


Many a landlord has evicted their tenants in the past without giving them a notice to quit. The uninformed tenants leave without arguing. In most cases, their landlords force them out if they refuse to leave.

But a landlord who intends to recover possession of his premises MUST issue a notice to quit in all cases, except the tenancy expires naturally. The notice to quit MUST stipulate a period within which the tenant must quit possession of the premises.


2. YOUR LANDLORD MUST GIVE YOU NOTICE OF OWNER'S INTENTION TO APPLY TO RECOVER POSSESSION:


If after your landlord has given you a notice quit, and you, for any reason, are unable to leave, your landlord CANNOT throw you out. He MUST give you a notice. Though your landlord's solicitor (lawyer) does not need your landlord's written authority to issue you a notice to quit, he needs your landlord's WRITTEN AUTHORITY to be able to issue you the notice of intention to apply to recover possession. Therefore, on the expiration of the notice to quit, if you are unable to leave your landlord's house (owing to financial issues or something else) your landlord MUST serve you with a written notice of his intention to proceed to recover possession on a date not less than 7 days from the date of service of the notice.


3. YOUR LANDLORD MUST APPLY TO THE APPROPRIATE COURT:


On the expiration of the time stated in the notice of intention to apply to recover possession, if you are unable to leave your landlord's house, your landlord may apply to the appropriate court for the issue of a writ. It is the court that will give an order that you should leave.


4. YOUR LANDLORD HAS NO RIGHT TO INTERFERE:


The landlord has no right to walk into your apartment or make use of any of your property without an express permission from you. You are by law in exclusive possession and can sue your landlord for trespass if he comes into your apartment without your permission. Your landlord has no legal right to decide who visits you unless your visitors constitute a nuisance to other tenants.


5. YOUR LANDLORD MUST KEEP HOUSE IN GOOD CONDITION:


It's an implied term of tenancy agreement that your landlord who let a building out must ensure that the building is in good condition. Where, after paying rent,you discover that the house is not in a habitable condition, you have a legal right to sue your landlord for refund of rent and adequate compensate for the inconveniences he caused you.
