Licensing requirements may include submitting contract forms, commission rates, references and even fingerprints to the state's labor commission or other licensing board, as well as maintaining a trust account and surety bond.


Requirement to obtain a license to operate as a talent agency:
No person shall engage in or carry on the occupation of a talent agency without first procuring a license therefor from the Labor Commissioner. The license shall be posted in a conspicuous place in the office of the licensee. The license number shall be referred to in any advertisement for the purpose of the solicitation of talent for the talent agency. (Labor Code section 1700.5)
Who must obtain a license to operate as a talent agency?

Definitions:
"Person" means any individual, company, society, firm, partnership, association, corporation, limited liability company, manager, or their agents or employees. (Labor Code section 1700) "Talent agency" means a person or corporation who engages in the occupation of procuring, offering, promising, or attempting to procure employment or engagements for an artist or artists, except that the activities of procuring, offering, or promising to procure recording contracts for an artist or artists shall not of itself subject a person or corporation to regulation and licensing under this chapter. Talent agencies may, in addition, counsel or direct artists in the development of their professional careers. (Labor Code section 1700.4(a)) "Artists" means actors and actresses rendering services on the legitimate stage and in the production of motion pictures, radio artists, musical artists, musical organizations, directors of legitimate stage, motion picture and radio productions, musical directors, writers, cinematographers, composers, lyricists, arrangers, models, and other artists and persons rendering professional services in motion picture, theatrical, radio, television and other entertainment enterprises. STEP 3: Find Great Talent:
Once you have learned enough to open up your agency, before you begin to market your new company, you need to find great talent to represent. Not having talented actors and models on your roster will give your agency a bad reputation. Not having the right people will make it almost impossible to get clients to hire anyone from your agency. Running a talent agency business, you begin to develop an eye for finding such talent. -

Finding talent to represent and then finding work for these talented people are the two main activities in running a talent agency business. Now, there is no end to the talent that you can find. People are trying to be discovered everywhere, even online – just think of all of the musicians and bands working hard to put a CD together and bringing it to the public view by posting it online on MySpace, Facebook and YouTube for instance, or those up-and-coming comedians who show bright promise at “open mic” nights at the local clubs and bars, or the young and hopeful future models who try to get discovered at auto shows and department stores selling perfume.

Remember those children in your church with special dancing skill, that skillful footballer in your street could be whom you need to make it to the top.

Decide what age range you want to specialize in. This decision will be influenced by the pool of available talent and the types of regional doors that are going to be open to your clients (i.e., magazines, runway, catalogues, commercials). If, for example, your agency is located near family-friendly suburbs, you're probably going to have a pretty steady stream of babies, toddlers and adolescents. If you live in a major city, there's going to be greater access to media gigs . You may need to consider relocation if you want your agency to be sustainable for the long term.

STEP 4: Finding works for your talented clients:

Now that you have your agency up and running, and great talent working with you, now is when you have to convince others that they need to book your talent.
