Rivers: Wike Appeals Tribunal Judgment by viviangist: 7:34am On Nov 05, 2015
Governor Nyesom Wike has appealed the judgment of the Rivers State Governorship Election Petitions Tribunal in Abuja which nullified his election.
In the appeal filed at the Appeal Court in Abuja on November 3, Wike is asking the court to set aside the judgment of the tribunal which nullified his election on October 24.
Justice Suleiman Ambursa in his judgment in the petition filed by the All Progressives Congress (APC) candidate Dakuku Peterside on Saturday, October 24 ruled that there were corrupt practices and substantial non-compliance with the Electoral Act in the April 11 election which produced the Peoples Democratic Party (PDP) candidate.
In the appeal by his counsel, Emmanuel Ukala (SAN), the governor established 26 grounds of appeal wherein he raised complaint against the entire judgment of the lower tribunal.
Wike’s appeal joins Peterside, APC, the Independent National Electoral Commission (INEC) and the PDP as respondents.
Wike argues that the tribunal erred in law when it relied on hearsay and inadmissible evidence to nullify his election.
He added that the finding and conclusion of the tribunal was not supported by evidence before the court.
No date has been fixed for hearing.
