According to section 140(2) of the electoral act 2010, whenever a tribunal or court nullifies an election on the ground that the person who obtained the highest votes at the election was not qualified to contest the election,..., the election tribunal or court SHALL NOT declare the person with the second highest vote OR ANY OTHER PERSON as elected,but shall order a fresh election. (Emphasis mine).

I knew this Taraba issue is a miscarriage of justice. Let those concern do the needful. Did anyone observed that there has not been any wild jubilation since this judgment was passed. |

That section of the electoral act has been thrown out of the window since time immemorial. Read here http://www.vanguardngr.com/2011/07/court-rejects-sections-of-2010-electoral-act/ PDP is a genuine loser on this one 1 Like |

OP learn to read an entire section b4 jumping to conclusion. U circle subsection two which says "the person declared winner was not qualified" however subsection three, the one after what u circled says "if the person declared winner did not score the highest vote at the primary of his/her party, the person who scored second highest vote @ the election shall be declared winner" that is the section the tribunal relied on as a matter of fact, INEC official told the tribunal that PDP did not conduct primary election which means PDP did not even have a candidate that is PDP was not represented at the election 3 Likes |

ayuse:And you better learn to get facts before typing in a public forum. The tribunal didn't say the PDP candidate failed to secure the highest number of votes. They based their judgment on the compromised testimony of an INEC official that the PDP didn't hold any primary election, hence the PDP candidate for the election was not qualified to contest the election. We saw a similar issue in Rivers State in 2007, the scenario that ousted Omehia of the PDP and brought in Amaechi, also of the PDP. Be informed. |

This is a total truncation of the independence of the judiciary by the same people who claim to be the demonstrators of change. To pofer à positive change, it begins with the correct interpretation of laws. Some sections of Legal documents are vague on issues but this one is very clear. I advise you to get a copy of the electoral act and the constitution. You'll be better informed. |
