The Appeal Court in Makurdi, Benue State, has upheld the ruling of the Governorship Election Petitions Tribunal which was in favour of the state governor, Chief Samuel Ortom.The appellate court, in its judgment deliveredby Justice Muhamad Garuba, dismissed the appeal of the Peoples Democratic Party candidate, Prince Terhemen Tarzoor, in the April 11 governorship election.Tarzoor had challenged the decision of the Election Petitions Tribunal that dismissed his petition and declared Governor Samuel Ortom as the duly elected governor of the state.Tarzoor had, on October 2, filed a 14-ground appeal, complaining that the tribunal erred inruling that Ortom was duly elected having not been properly nominated by the All Progressives Congress (APC) to contest the April 11 governorship election in the state.Justice Garuba dismissed Tarzoor's appeal and upheld the judgment of the tribunal delivered on September 29.He said the appeal failed on all grounds, noting that rightly put, the evidence adducedby the first respondent (Ortom) and second respondent (APC) outweighed that of Tarzoor."The burden rests on the petitioner who approaches a court to prove his petition. On the evaluation and examination of evidence, the tribunal did the proper and right things. The appeal fails on all the grounds and is hereby dismissed. We uphold the judgment of the tribunal delivered on 29 September, 2015.Reacting to the judgment, counsel to Tarzoor, T.T. Hyundu, said they would study it and decide on the next step to take.

Benue is an APC state. PDP should stop wasting its money and time on unnecessary litigation. The court will never give back to them what they lost squarely on election day.
