This is the situation where dialogue, negotiation, compromise and a smooth tongue are needed.

Man #1 is at more risk, especially if the cliff is a very high one. If man #2 quickly jumps sideways, the short range might ensure the bullet doesn't miss, but it may not hit important organs (head, heart etc) and man #1 plunges to his death. What is he even smiling for?

1 of course. 2 can dodge the bullet or get shot in the arm or whatever. It isn't likely the bullet must kill him. But for 1 he will definitely fall and die depending on the heights.
