The Supreme Court, on Wednesday, February 24, stopped just shy of saying Senators Stella Oduah and Andy Uba, and other lawmakers elected under the Peoples Democratic Party, PDP, in Anambra State, are to retain their seats.

Though not ruling on the matter, the Court said the issue of primaries was not included in the appeal that came before it.

One Supreme Court Justice said in fact, the matter was filed at the High Court, even before primaries was held.

The Justice pointed out that the Supreme Court had ruled severally that only the National Executive of a party can forward a list to INEC, and since INEC said it was the National Executive that did that, and not the caretaker committee, then there was contest.

History of case

Recall that the Supreme Court, on Friday, January 29, ruled that Ejike Oguebego was the recognized state chairman of the Peoples Democratic Party, PDP, in Anambra State.

Many reports interpreted the judgement to mean that Senators Stella Oduah and Andy Ubah, and other PDP lawmakers had been sacked by the court and their elections nullified.

Both Oduah and Ubah reacted, debunking the claim.

Oduah, representing Anambra North, Stella Oduah, said the reports were “mere misinterpretation of the Supreme Court rulings and should be disregarded in all entirety‎.”

She said her lawyers had already forwarded the judgement of the Supreme Court to the Independent National Electoral Commission, INEC.

She emphasized the “Supreme Court did not order the withdrawal of the Certificates of Return issued by the Commission to our clients.

“They did not hold that the faction of the PDP had the right to sponsor candidates for the Peoples Democratic Party (PDP).”

Ubah, representing Anambra South, also maintained that the Supreme Court judgment which reaffirmed Ejike Oguebego as Anambra PDP Chairman does not affect their seats in the National Assembly.

“It is the national that conducts primaries, not the state. So the issue of him being the one that we came under does not exist.

“The judgment is very clear. The Supreme Court did not get into the issue of nomination or who is supposed to be sitting in the Senate. All they did was to deal with the issue of who is the authentic chairman of PDP,” Ubah said.

“When he went to court, Ejike Oguebego was not discussing the primaries or who the candidate was. What he wanted was for him to be restored as Chairman of PDP.

“Court did not say that we were being removed or it affected our seats as Senators of the Federal Republic or members of the National Assembly.” he added.

The numerous interpretations led INEC to say that it would approach the Supreme Court for clarification on the political status of Senators Uba, Oduah and other lawmakers representing Anambra State for the PDP.
