I am not a lawyer, so therefore, I can't give an expert opinion to your question. Maybe naptu2 can help out.

But from my layman understanding of law, I think he can appeal the ruling but the trial will continue irrespective of the appeal since the case is a criminal one. The recently passed administration of criminal justice act allows for trial to continue even when issues of jurisdiction is under appeal.
