The CFRN 1999 (as amnended) provides for legislative powers to reside on the National assembly. We (Nigeria) recognize and operate separation of powers between the three arms (legislature, Executive and Judiciary) of Nigerian Government. The classical approach to the doctrine of separation of powers (in the days of Locke) would have been that absolute discretion and non-inteference. But the refining of the above doctrine holds that except power is checked, it shall be abused. Knowledge of Administrative law (even in Nigeria) has shown that checks and balances exist and thrives to prevent and, or rectify any abuse of power by any arm, tier, agency, parastatals, person or body of persons in the use of power or discharge of their duties. There is what is called judicial review and it is aimed at rectifying whatever misdeed or ultra vires acts by any power-wielder. Having said that, there is no cause for alarm. The courts, a competent cocurt with the requisite jurisdiction, will pronounce on the exercise currently being carried out by the senate, so that where necessary, such exercise will be reviewed in the interest of justice. MOST IMPOrTANTLY: laws when made do not operate retrospectively, rather laws can only begin to have force the day it was assented to by the pesident or the day that NASS override the presidential veto (if the president vetoed the bill). It should be acknowledged that Saraki's alleged offences are in the past and laws made today cannot apply. The law(s) in force when an offence was committed will apply. Saraki belongs to the legislature, but the ìnterpeters of laws is the judiciary. No fear nor favour applies in there. 1 Like |

princemillla: If the Saraki-led senate repeal or re-enact the CCT Act, it will not operate retroactively, rather its operation begings the day it became a law. Sarakin's alleged offences are in the past and governed by the law in force when the offences were committed. So chill! |

Which means that the Law Amendment will favour the next (THIEF) on the seat and other Senators whose hands are dirty and haven't been exposed..hmnn...but does this prevent the EFCC/ICPC instead of the CCT to take on these guys and try them when the CCB notices wuruwuru in their asset declarations? And come to think of it, the Senator who proposed the bill has been exposed by Sahara Reporters of also having undeclared assets and in other words, the Senate is trying to insulate itself from external attacks and perpetuate corruption in the membership of the hallowed halls.
