AN ANALYSIS OF THE RIGHT TO FAIR HEARING VIS-À-VIS THE USE AND ABUSE OF EX-PARTE INJUNCTIONS
ABSTRACT
The purpose of this research work is to decipher the grant of ex parte injunctions by the court is in any way contrary to the exercise of the rule of fair hearing. The King James Version of the Holy Bible in Proverbs 18: 17 states that “He that is first in his own cause seemeth just; but his neighbour cometh and searcheth him” thereby making room for what in legal terms is encapsulated in the renowned Latin maxim “Audi alteram partem”, meaning ‘let the other party be heard’. An injunction is an equitable remedy and it can only be granted in support of a right known to law and equity while the ex-parte injunction in particular is that which is granted by the court to a party without the notice of the other in order to maintain subject matter in extreme emergency situations.
In its first chapter this research piece centers on the Definition, Origin and Evolution, Categories of Injunctions, as well its purpose and the prerequisite tests to be applied. Chapter Two delves into details on fair hearing, namely the meaning, nature and scope of fair hearing, its evolutionary course and contemporary connotations as well the Audi alteram partem rule. Chapter Three has to do with particular form of injunction under focus-the ex parte injunction-and is a depiction of its connotation, features as well its use and abuse within the Nigerian corpus juris. Chapter Four presents the interrelationship between the granting of ex parte injunctions on the one hand and protecting the right of fair hearing on the other. The work ends with a concluding chapter where recommendations are made for better use of injunctions generally.
