But if the girl was raped at age one and is now 3 years old, how does a 1 year old point out the suspect after 2 years?

The matter is statute barred... a rape must be reported within 2 months of the act, so as to be able to conduct a proper medical examination of the labial minora.

There are some unanswered questions in this story
How did the doctor determine that sexual intercourse occoured 2yrs ago and that the suspect was responsible.

Its not as if they found his semen in the girls genital.

Or did the doctor determine sexual intercourse occoured because she had an S.T.I. Then he would have to explain how he dated the infection to be 2 yrs old.

Or did he determine sexual intercourse occoured because of a laceration. That should have healed by now and anything could have caused that.

Just trying to think of how a doctor would determine that sexual intercourse occoured 2 yrs ago.

The only way i can think of is that he asked the child but for a 3 yr old child to have good memory of what happened 2 yrs ago is not likely.
