According to new statement which emerge from the Presidency on Sunday night, claims that the arrest of some judges by operatives of the Department of State Services was not a Judiciary attack, in the statement released by Senior Special Assistant to the President on Media and Publicity Mallam Garba Shehu, it says Nigeria President Muhammadu Buhari will not take an action which violate the constitution

The statement reads

1. The Presidency assures that the President reserves his highest respect for the institution of the judiciary as the 3rd arm of government.

2. To this end, the President will not do anything to undermine its independence.

3. President Buhari remains a committed democrat, in words and in his action, and will not take any action in violation of the constitution.

4 The recent surgical operation against some judicial officers is specifically targeted at corruption & not at d judiciary as an institution

5. In a robust democracy such as ours, there is bound to be a plurality of opinions on any given issue,...

6. ...but there is a convergence of views that the country has a corruption problem that needs to be corrected.

7. But reports by a section of the media are giving us cause for concern.

8. In undertaking the task of reporting, the media should be careful about the fault lines they open.

9. It is wrong to present this incident as a confrontation between the executive and judicial arms of government.

10. The Presidency has received assurances from the DSS that all due processes of the law, including the possession of search...

11. ...and arrest warrants were obtained before the searches.

12. To suggest that the government is acting outside the law in a dictatorial manner is to breach the interest of the state.

BASIC GUIDE TO ARGUING EITHER IN FAVOUR OR AGAINST THE RECENT ARRESTS OF SOME JUDICIAL OFFICERS BY THE DSS.
Before you argue either in favour of the recent arrests of some judicial officers by the DSS, it is important that most of you know the following facts. They will guide you to argue intelligently and intelligibly. This is my part of contribution to the change agenda.

1. No judicial officer has immunity against, arrest, search, investigation and/or prosecution in respect of an allegation of crime.

2. The National Judicial Commission (NJC) is responsible for the appointment, discipline/punishment of judicial officers only in respect of breach of judicial ethics, and not crime.

3. Even where a judicial officer has been sanctioned by the NJC for any misconduct, the state still reserves the right to prosecute the erring officer if his misconduct amounts to a crime.

4. The Administration of Criminal Justice Act (2015) is the procedural law that guides the activities of all federal investigating and prosecutorial agencies like the police, EFCC, ICPC, DSSS,etc., as well as the Federal High Court, High Court of the FCT, National Industrial Court, Code of Conduct Tribunal, etc.

5. Any action taken by any prosecutorial agency either during investigation or prosecution must be in line with the ACJA

6. Under the ACJA, there is no time limit or time frame when a person can be arrested. There is no day that a person cannot be arrested.

7. Sections 12 (2) & 13 ACJA give a law officer the power to break into and out of any house for the purpose of arresting a suspect who fails to let the arresting officer in.

8. Section 43 (1) ACJA states: "A warrant of arrest may be executed on any day, including a Sunday or public holiday."

9. The person arresting may not necessarily be the person to prosecute. A private person may arrest a suspect and hand him over to a prosecuting authority(Section 23 ACJA).

10. A person may be arrested notwithstanding that the person arresting him is not in possession of an arrest warrant on demand, but can show the warrant as soon as practicable. Section 44 ACJA.

11. "A warrant of arrest issued by a Federal High Court sitting anywhere may be executed in any part of Nigeria." Section 47 (1) ACJA.

10. A search warrant can be executed by anyone to whom it is directed (Section 147 ACJA).

12. "A search warrant may be issued and executed at any time on any day, including a Sunday or public holiday."(Section 148).

13. Apart from the President, vice president, Governor and a Deputy Governor, no other person has immunity from arrest and/or prosecution

Why all this argument? Are judges above the law? Are they not human again? Was there search warrant? If DSS can arrest mr A, why can't they arrest the judges? Infact if arresting our corrupt judges will make an ordinary citizens get justice then so be it.
Imagine ibori acquitted of crime but within a year was sentenced to prison in uk. Is that not enough to even incarcerate the whole NBA?

Nigeria naija 9ja, You don't chase bad kid for lion to kill.
As we all know almost all sectors in 9ja is beautifully corrupt but giving out our freedom by style to fight the corruption is not the best option. I think the FG have to act within the rule of law before we enter North Korea

Corruption is so entrenched in us that it is abnormal not to be corrupt.
Flush them out. After the judiciary, kindly visit the parliaments and cap it up in the executive arm.

Let who want to cry cry, who wants to wail-wail, who wants to shout - shout......

When abnormalities become the norm!

God Bless Nigeria

I don't even understand this world we are living right now. Our leaders we expect to change this country for the better, that we youths look up to; are the ones encouraging corruption, hindering this nation from reaching glorious days. Our judges shouldn't be the ones encouraging corruption. Abeg anyone found guilty should be punished by death!!
