Buhari and $3 billion


Now, some are lapping up the fable that if Buhari comes in as President, corruption and embezzlement in high places would come to an end. But I think this is like the story of the child and Santa Clause.

That reality does not exist now or in the future, because the reality of who Buhari is has been shown to us through his real actions, not by the pictures and images being put out there by his spin-doctors and uncritical supporters.

Should I start with the scandal of the N2.8 billion NNPC money that got stolen under his watch as Petroleum Minister and head of NNPC in 1978? Let’s bear in mind that the value of that money in hard currency at the time was more than $3 billion. Under intense public pressure, the Shehu Shagari government, which shortly took over thereafter from the military, set up a Senate probe which traced the money to a London Midland Bank account belonging to Buhari from where the money again got missing.

No less than a person of the then Senate Majority Leader and Chairman of the Senate probe panel, Dr Olusola Saraki revealed this in an interview with Vera Ifudu of the Nigerian Television Authority (NTA). When Ifudu reported this, she was clandestinely sacked by the NTA, but the lady went to court and presented all the evidence and won in a case of wrongful dismissal. Saraki till his death never denied what he told the lady. In the end, they settled Ifudu with a big payout to buy her silence.

"He who comes into equity must come with clean hands."

This maxim bars relief for anyone guilty of improper conduct in the matter at hand. It operates to prevent any affirmative recovery for the person with "unclean hands," no matter how unfairly the person's adversary has treated him or her. The maxim is the basis of the clean hands doctrine. Its purpose is to protect the integrity of the court. It does not disapprove only of illegal acts but will deny relief for bad conduct that, as a matter of public policy, ought to be discouraged. A court will ask whether the bad conduct was intentional.

This rule is not meant to punish carelessness or a mistake. It is possible that the wrongful conduct is not an act but a failure to act. For example, someone who hires an agent to represent him or her and then sits silently while the agent misleads another party in negotiations is as much responsible for the false statements as if he himself or she herself had made them.

The bad conduct that is condemned by the clean hands doctrine must be a part of the transaction that is the subject of the lawsuit. It is not necessary that it actually have hurt the other party. For example, equity will not relieve a plaintiff who was also trying to evade taxes or defraud creditors with a business deal, even if that person was cheated by the other party in the transaction.

Equity will always decline relief in cases in which both parties have schemed to circumvent the law. In one very old case, a robber filed a bill in equity to force his partner to account for a sum of money. When the real nature of the claim was discovered, the bill was dismissed with costs, and the lawyers were held in Contempt of court for bringing such an action. This famous case has come to be called The Highwayman (Everet v. Williams, Ex. 1725, 9 L.Q. Rev. 197), and judges have been saying ever since that they will not sit to take an account between two robbers.

2. The ₦45 billion he stole in partnership with Abacha when he was Chairman of the Petroleum Trust Fund.

3. Explain to Nigerians why he made the claim in Kano in 2008 that "Abacha didn't steal any money from Nigeria".

4. Why in 1984 he allowed the Emir of wherever to import 53 suitcases full of currency during a time such was expressly prohibited by his own Federal Military Government.

Once again, my pity is reserved for Nigerians who have no option but to live in Zoo/Nigeria. All the excuses in the world aren't going to change the fact that Buhari has been a disaster.

Stopping making excuses for a Brainless Dullard and the Zoo/nigeria, you're better than that, if you're not one of those undomesticated dark monkeys !!!

OP! Can't you see your thread is full of comments that doesn't show good morals because you started it by calling this country a zoo?

No amount of corruption or quantity of bad leadership will make me hate my country because there must be a reason I was born into this country and I'll do anything to be part of the few who will bring about a positive change in my own little way.

... what a statement! That was politically incorrect.

The ill adviced President totally forgot that he is standing next to a woman who is a world leader.
Here in Germany as in the rest of Europe, the issue of women's right is a delicate one as women have come a long way fighting inequality in both society and at work place. Without warning, a visibly angry Mrs Merkel (the German Chancellor) quickly ended the press conference to save the President further embarrassment.
The emancipation of women in Europe is a civil rights issue, that is why feminist groups in Germany immediately reacted to his outing as a hate speech and demanded his exit from their territory. A German opposition leader called for his immediate expulsion from Germany, while a renowned German newspaper in its editorial, has this to say about our President.
