Controversies erupted in the National Assembly today over what the NASS termed as unconstitutional resolution of President Buhari to have ordered the deployment of Nigerian troops to Gambia without permission from the Lawmakers, an act describes as an impeachable offence before the law. The Senate on Thursday criticised the Federal Government under the leadership of President Muhammadu Buhari for deploying troop in Gambia without seeking legislative approval. The Nigerian Air Force had moved a contingent of 200 men and air assets, led by Air Commodore Tajudeen Yusuf, to Dakar, Senegal, which is the base of the Economic Community of West African States Military Intervention to force President Yahya Jammeh of The Gambia out of power. The Nigerian troops, which left from the 117 Air Combat Training Group camp in Kainji, Niger State, on Wednesday, joined troops from Senegal, Ghana and other countries in the West African sub-region. But Senator Chukwuka Utazi, while raising a constitutional point of order, said what the Buhari-led government did was against the law, citing Section 5 (4) of the Constitution. Section 5(4) states, “(a) the President shall not declare a state of war between the federation and another country except with the sanction of a resolution of both houses of the National Assembly sitting in a joint session; and (b) except with the prior approval of the senate, no member of the armed forces of the federation shall be deployed on combat duty outside Nigeria.” Observation of Senator Utazi, however ignited the upper chamber into insinuations among the opposition members proposing impeaching Mr President for his nonchallant attitude. This shows our senators lack in depth knowledge of our constitution. They just brandished it at will. The PDP is a wounded lion wailing and whinging pointlessly. They're losing senators on weekly basis and they're just being frivolously frantical .... Saraki, while responding, faulted Utazi’s claims and argued that President Buhari was still acting within the confines of the law. He said President Buhari can deploy troops, as long as the operation does not exceed seven days. Quoting Section 5(5) of the 1999 Constitution as amended, Saraki maintained that until the expiration of seven days, no one can fault the action of the President. Saraki argued: “The point made is noted, but the explanation concerning the constitution is confusing. I believe the constitution gives room for the president, within seven days for such an action to come before us.” Section 5(5) quoted by Saraki reads: “Notwithstanding the provisions of subsection (4) of this section, the President, in consultation with the National Defence Council, may deploy members of the armed forces of the Federation on a limited combat duty outside Nigeria if he is satisfied that the national security is under imminent threat or danger. Provided that the President shall within seven days of actual combat engagement, seek the consent of the Senate and the Senate shall thereafter give or refuse the said consent within fourteen days.” CONTINUE... https://www.ripplesnigeria.com/saraki-ekweremadu-utazi-clash-buhari-sending-troops-gambia/ 6 Likes |

In your life ve u even opened the so called constitution for once? The president has the right as a matter of urgency to deploy military personnels for such a thing and send letter to the senate within 7 working days for approval Which means the president still ve 6days to do so! One of the fundamental principles in Nigerian Foreign policy is *the policy towards her neighbors* which one of the principle is "Non-interference in the internal affairs of other African States". Buhari sending our soldiers to Gambia even when we are overwhelmed with problems of insecurity domestically, is it proper?? I don't care about his interest or intentions in doing such but did he followed due process?? If yes, was all alternatives exhausted? |

The senate should grow some balls and impeach him, he is of no use to me or my country, Buhari is not Nigeria, he is a man, and an incapable one at such, frequently sick and not adapatable to the changing world, he is in fact holding Nigeria from reaching its full potential, it would be of great service and patriotic to the nation both dead and the living if he is removed, forcefully or not. Buhari is not Nigeria, and Heavens will not fall if he is impeached, the era of imputiny or a one man leader cult should be over and done with, if we really want Nigeria to move forward we should be prepared to remove the shackles of our past and the weak links, presently being Buhari and his gang of corruption |
