No he cannot. He only acts until the Senate considers his appointment which is subject to the confirmation of the Senate. The moment his appointment is considered and rejected, he loses his acting capacity. If nothing would change then why d constitutional requirement for Senate screening and confirmation? It is is also why if the Senate had confirmed him, he'd have moved from acting to substantive with a statutory tenure.

Bottom line is that his position must change either to substantive chairman or no chairman at all based on the outcome of his screening by the Senate.

He can keep Acting and the President can keep nominating him for confirmation and if Senate likes, they can keep rejecting.

Then the President had better re-appoint abd re-present him to the Senate for confirmation because as it stands, his previous appointment dependent on the confirmation of the Senate has lapsed with the rejection by the Senate. That will of course amount to Executive rascality and an abuse of legislative processes because the issues raised against him on the basis of which his confirmation was rejected remain unresolved.

It will also mean that the NASS wil be forced to enact a law that majestic it impossible to re-submit a nominee or appointee previously rejected by the Senate to the Senate for confirmation into the same position or office.

he was called mr investigation when he was nominated in november 2015 but no investigation has been concluded. it is quite disheartening to note that weve been running in circles not even Dasuki sambo has been sent to jail for corruption and this regime is supposed to b an Anti corruption term. its a pity he didnt live up to alot of expectations .

The last Senate tried to introduced that into the constitution, it was not signed by GEJ. No President will sign the amendment. It is is exercise in futility, a waste of time and tax payers' money because it is a Dead On Arrival case.

Acting Chairman of the Economic and Financial Crimes Commission (EFCC), Mr. Ibrahim Magu, has rented a mansion in the elitist Maitama District of the Federal capital territory (FTC) Abuja, News Express can report this morning.

The storey building located at No. 8B, Rudolf Close, off Katsina Ala Crescent, in the highbrow Maitama District, was the abode of a former federal minister who died some time in May 2014.

An impeccable source said: “The property was rented to the Acting EFCC Chairman for N40,000,000 at N20,000,000 per annum.

“Furthermore, the Federal Capital Development Authority (FCDA) curiously awarded a contract to Africa Energy, a company owned by Rtd Air Comm. Umar Muhammad, to furnish the residence at the cost N43,000,000, in a Government where the President is known to have frowned at and rebuked his ministers for requesting N20,000,000 each to secure accommodation and furnish them.
