Unfortunately for you and the corrupt Senate, he can serve in the Acting capacity till the end of this administration.

Nothing changes.

No he cannot. He only acts until the Senate considers his appointment which is subject to the confirmation of the Senate. The moment his appointment is considered and rejected, he loses his acting capacity. If nothing would change then why d constitutional requirement for Senate screening and confirmation? It is is also why if the Senate had confirmed him, he'd have moved from acting to substantive with a statutory tenure.

Bottom line is that his position must change either to substantive chairman or no chairman at all based on the outcome of his screening by the Senate.

Ozekhome said that Ibrahim Magu has henceforth ceased to be the Chairman of the EFCC going by the powers vested on the Senate by the constitution.
He said, “Going by sections 2(1) and 2(3) of the EFCC Act, he ceases to be the Executive Chairman. Having left his “acting” position during his proposal to the Senate, he also loses his “acting” capacity. It is simply a bad case.

“The Senate is the only repository of confirmatory powers of the EFCC Chairman. And it has spoken. That is the beauty of the doctrine of separation of powers between the three Arms of government, the Executive, the legislature and the judiciary...

Do u see the law now? Separation of powers are constitutional provisions. That the Senate is the only repository of confirmatory powers is also statutory which is why the appointment of the EFCC chairman by the President is subject to the confirmation of the Senate. The first wasn't a full screening by the entire Senate but only of the Committee who considered the report against him and declined to screen or confirm him. This was a full exercise put to vote...There's a world of difference.

i asked my colleagues today after his rejection a simple question " what has Magu achieved in more than a year in charge of @efcc?"
media trial is the only thing anyone could come up with. his out right disdain for the rule of law et al are some of my main problems with the man.
disobedience to court orders and "bigger than the courts" attitude is not what we need in a democracy

no single high profile case has been closed in the courts (a whole lot have been prosecuted in the media tho) this is not what we want with our efcc
he was called mr investigation when he was nominated in november 2015 but no investigation has been concluded. it is quite disheartening to note that weve been running in circles not even Dasuki sambo has been sent to jail for corruption and this regime is supposed to b an Anti corruption term. its a pity he didnt live up to alot of expectations .

The last Senate tried to introduced that into the constitution, it was not signed by GEJ. No President will sign the amendment. It is is exercise in futility, a waste of time and tax payers' money because it is a Dead On Arrival case.

For every alteration or amendment to the constitution or any Act in this country really now, the President must sign before it can become a law.
