Lagos tackles FG in court over N50 stamp duty

The Lagos State Government has approached the Supreme Court to challenge the collection of N50 stamp duty by the Federal Government on every N1,000 transaction conducted by customers in all commercial banks operating in Lagos State.
In an appeal filed before the apex court by its Attorney General and Commissioner for Justice, Mr. Adeniji Kazeem, Lagos State is contending that it ought to be the one collecting the N50 stamp duty rather than the Federal Government.
Kazeem argued that by virtue of Section 4(1) of the Stamp Duties Act, Cap S8 Laws of the Federation of Nigeria, 2004, the Federal Government had no right or power to collect and keep money paid as stamp duties on behalf of federating units.
Lagos State urged the Supreme Court to declare as illegal the instruction given to the Central Bank of Nigeria to deduct and remit to the Federal Government N50 stamp duty collected on every N1,000 bank transaction conducted within the Lagos State territory.
The state wants the apex court to make an order compelling the Federal Government to remit to it all such monies it had so far collected as stamp duty on bank transactions conducted within the Lagos State territory.
Kazeem argued that Section 163(b) of the Constitution gives the state an entitlement “to the sum equal to the proportion of the net proceeds of the sum collected as duties on such transaction within the territory of Lagos State.”
While urging the Supreme Court to interpret the provisions of the Stamp Duties Act, 2004, he expressed the belief that Section 4(2) of the Act makes the collection of the N50 stamp duty the exclusive preserve of the state.

Even if Lagos wins the case, they will use theirs judiciously while others will simply loot theirs.

For now I trust this FG, still leave it with FG until we have more responsible Govts at State level.

Lagos State Government treats income generated within it the same way the indigenes of the Niger-delta treat the oil found within their various states.

Ironically, the various Lagos State Governors and functionaries have not spoken in support of derivation from solid minerals.

They on one hand enjoy monies received from the Niger-delta and still want to exclusively enjoy monies generated within Lagos State.

80% of the company income tax, value added tax, education tax and custom duties generated in Nigeria comes from Lagos state and the state is not complaining. It is a sacrifice they have to make for the development of the country.

Going to court over the stamp duty act for interpretation is a matter of seeking legal clarification. The same way Niger Delta states are sacrificing for the nation is the same way Lagos is sacrificing as well. Stop trying to blackmail Lagos into supporting your agitation.

Every mineral producing state gets 13% derivation while Lagos state gets no special derivation for the huge VAT, custom duty, company income tax generated within her territory.
And some still have the mentality they are the only one sacrificing or feeding the nation

it is the Niger delta folks that are always dulling themselves all in the name of using militancy to demand for their rights. Lagos state is only teaching Niger deltans how to go about demanding for your rights in the 21st century. no be everything be gra gra or breaking of bottle

Some years ago during tinubu's regime, Lagos went to the supreme court over the issue of wharf landing fees at the ports, they won the case and today for every container landing at the ports, Lagos state collects between 50k to 100k per container depending on the size.

Make my Niger delta peeps dey dull themselves by blowing pipelines, Lagos knows how to go about their rights codedly and lawfully!

Are you telling this house that there are no banks and deposits in Port Harcourt, Asaba, Uyo, Calabar etc that will generate big money for them except Lagos? I am assuming there's none in your jungle.
This fight is for all states of the federation and stop being limiting in your thought process.

Wow. This is nice. Funny enough when this charge was introduced about two years ago some informed minds on twitter said that there was going to be a challenge by the States as regards this stamp duty and it is happening now. I am tired of the FG emasculating states all in the name of Unity. The Federal Government just took all the whole essential powers which can make or Mar a state to ensure "equal development". Instead what we have gotten is equal underdevelopment. Let every state decide it's destiny and even though development will greatly vary at first, the progress of some states will make other states seat up.

anambra and abia control more cash transactions than any other state in southern nigeria apart from Lagos and rivers

That is an assumption with no evidence. The government WHAT EXACTLY Is the FG Invesment in Lagos please tell us what it is that tthe FG has done in Lagos that was not there before oil or paid for b reenue generated in Lagos > Lagos has ALWAYS been a net contributor to the federation account so please stop talking nonsense about oil. If you are looking for FG investment go to Abuja NOT Lagos?


FYI Lagos State was not the capital of Nigeria If you learn anything today learn that.

Please list the so-called FG investments in Lagos state that comes from oil proceeds.

These are two different things u are comparing. Niger delta also generates its taxes to the exclusion of others. And no, oil money doesn't go to lagos but to the whole federation, together with fg other sources of income. U gerrit??

Do you also remember when Ambode said he wants Lagos to become the 3rd largest economy in Africa by 2020

See the way Lagos is just doing everything to increase it's IGR grin

That's what you get when you have a reputable accountant managing the affairs of the state.

I just trust the state would use the money got judiciously.

Don't mind those ones who throngs online to perverse what the constitution says. And they are the ones, Who will keep claiming right over tribe's resources. I beckon on all south western states to look critically at the constitution to take the federal government to the court of law. Perhaps, all other sensitive states of the federating which believe in State's right to own its resources because of this EXCLUSIVE RESOURCES that belongs to federal government of Nigeria, which was devilishly crafted to destroy Nigeria. I am convinced, once all the federating States in Nigeria, take the federal government to the court of law. It is probable for the constitution to be forcefully amended and which may pave way for the gradual taking back rightfully what belongs to each state of the federation. After all, they created a monstrous constitution with flaws and they have refused to amend it because of absolute wickedness and insanity. I have never seen a mushroom Democratic setting as bad as Nigeria, which practise Federalism . It is indeed a shame when a state will have resources to sustain itself and yet, one draconian constitution with no human face will hamper its development. Let Lagos state, which always set pace, for others to follow, need ride on to glory.
