Police arraigns alleged Sterling Bank Whistle-blower, Blogger

The Nigeria Police Force has arraigned a self-acclaimed whistleblower, Dennis Ukpabi, and a blogger, Fejiro Oliver, for cyber stalking.

It was learnt that Ukpabi, who is a former employee of Sterling Bank Plc, was arrested for publishing a book titled, ‘The Whistleblower’, in which he accused some employees of the bank – Adekanla Desalu, Eguru Nyenke, Janet Akpan and Kojusola Ajao – of fraud.

Ukpabi also alleged that after exposing the fraud in the bank, one of his colleagues involved in the fraud was promoted because she was dating an executive director at the bank.

Ukpabi and Oliver were arraigned before a Federal High Court in Lagos on Friday on five charges bordering on alleged acts of ‘cyber stalking’, which are said to be punishable under the provisions of Section 24 of the Cybercrimes (Prohibition and Prevention etc) Act, 2015.


The first charge read, “That you Dennis Ukpabi and Tega Oghenero between 1st – 13th February, 2017 in Lagos within the jurisdiction of Federal High Court, conspired together to commit felonies, namely, knowingly and intentionally sending intimidated, hatred, insulting and needless anxiety messages and thereby committing an offence punishable under section 27 (1) (b) of Cybercrime (prohibition, prevention etc Act 2015).”

Another charge read that the accused sent offensive messages to Desalu, Busola Awosile, Nyenke and Adeyemi Odubiyi, which are said to be ‘’punishable under section 24 (1) (b) of Cybercrime (prohibition, prevention etc Act 2015.’’

The defendants pleaded not guilty to the charges.

The prosecution counsel, who is also a Superintendent of Police, Mr. J. Oloruntoba, asked the court to remand the defendants in prison custody. Frantic efforts were made by lawyers representing the two defendants; Mrs. Kitan and Mr. Inibehe Effiong, to persuade the court to admit them to bail.

Effiong, who is a human rights lawyer, informed the court that the defendants were accosted by the police and arraigned surreptitiously without proper and adequate notice.

The trial judge, Justice Mohammed Idris, asked the defendants’ counsel to bring a formal application for bail and promised to hear it expeditiously.

The judge remanded them in Ikoyi Prison

First, these charges are BAILABLE...and the accused should be offered bail.
On this ground, remanding them in prison gives the impression that a lot of "Big men"`, including Senators are Judges in our society, are bent on "killing" the whistle-blowing culture. This is sad indeed.
The crime is not a criminal offence because at worst case, it bothers on Slander or Libel, as the case may be.
Its Civil case, the Police should have no hand in it.

On the other hand, these Lawyers (especially the Human Rights Lawyers) should be up to the task.

The case was taken to the High Court and any Lawyer worth his salt should know that "Oral" bail application is not allowed in the High Court.
It has to be "Written and Pleaded"
(and BTW, except the Judge uses wisdom, it is usually not done on same day...so Kudje straight! grin)`````````````


Finally, looking at the charges, it is obvious they have nothing to do with the Whistle-blower.
These trump-up charges are just a fight back, using corrupt Police, to intimidate the Whistle-blower.


Fed Govt needs to pay very close attention to Judges (and Police) that are used to frustrate whistle-blowers.

Corruption is doing press-Ups and fighting back.
Citizens need to be strong and fight back too

This was no whistleblowing anything. The guy just wrote a book and made some accussations. This was no whistleblowing as we know it.

Too bad, your whistle is a second hand whistle, try to upgrade your whistle when you are out of jail, na drum me go dey use now, i think the whistle is small grin grin grin arraign in court, after that rest in jail.

This isn't a whistle-blowing case gone wrong as the title suggests,
it is a feud between an ex-employee and his former colleagues,
he should have contacted efcc with evidence instead of publishing
a book and endangering his own life.

It is a truism that corrupt people are always shielded frm the eyes of the law, especially in financial corporate bodies... So if u wanna blow a whistle always remember to have allies in the bank or probably having sex with the director's wife or any of his daughter.. Or both at the same time.. Standing for justice is good.. But ensure that the benefits outweighs the consequences of ur actions...

Nairalanders and Nigerians should take note. This case has nothing to do with whistle blowing. The only whistle blowing policy we have nationally is the one initiated by the Ministry of Finance for recovering stolen money.
In this case an aggrieved employee aware of some dealings between his boss and some of his colleagues went and spilled to bloggers and the press, not the Police or EFCC. This case has absolutely nothing to do with whistle blowing.

He published his book long before FG policy on whistle blowing. David Upkabi should be released and those people investigated.

This is a case of the hunter becoming the hunted.
