Barely forty eight hours after the Chief Judge of the Federal High Court, Justice Daniel Abutu gave a judgment ordering Vice President Goodluck Jonathan to start performing the duties of a president, the same judge was forced to step down from hearing a similar suit filed by Lagos lawyer, Mr. Femi Falana.

On Thursday at the resumed hearing in cases similar to the one he had already given judgment, Justice Abutu agreed to step down following a request by Falana.

The Lagos lawyer referred Justice Abutu to the judgment he delivered on Wednesday 13th January wherein he ordered the Vice President to perform the duties of president in the absence of the president and without the president writing a letter to the National Assembly to inform the lawmakers of his absence.

Falana said that the Judge had delved into the issues raised in his own case and had already taken a position which would affect his decision if he were to go ahead and hear his (Falana) case.
