It's an instrument used by the three arms of govt. to check on the excesses of each other in order to prevent abitrary use of power by any of the arms of govt. In diz case each arm of govt. is suppose to act as a watch dog on the others so as to ensure that they act only within the confines of the constitution. So I think the senate is only trying to bring it(checks & balances) into play......don't 4get diz is a Democracy.

what is this one saying? The constitution gave them power to screen and confirm presidential nominee. Any nominee not approved by the Senate is automatically disqualified so since the Senate rejected the nomination of magu, he is automatically disqualified

Thats if the power of jurisdiction of any of the arm of government is not undermined or subverted as outlined by the constitution,then any decision based on "checks and balances" is null and void..in this case the legislators are acting base on political sentiment not legitimate,they have acted on their right not to screen Magu but they cant force the executive to drop him as an acting efcc chairman
