By AGENCY REPORTER, Published: Thursday, 18 Feb 2010

IG ONOVO

Justice Olubunmi Oyewole of an Ikeja High Court on Thursday, ordered a Police constable, Alibor Narman to pay N10m as fine for allegedly shooting a commercial bus driver, Mr. Sunday Awoyera.

Delivering his Judgment, Justice Oyewole held that with the medical report of the victim “there was severe tissue loss, there was deep laceration of the mandible of the bones.

“I declare that the action of the police officer is unconstitutional, as it violates the applicant’s right to life.
“The dignity of the applicant has been significantly impaired upon, his person was trampled upon and he will live with the nightmarish incident.
“I hereby award the full sum of N10 million jointly and severally against the respondent”

Awoyera had sued Narman for shooting him at a Police check point in Igando, a suburb area of the state, while in company of his wife and children on August 2, 2008.

This man is what the Nigerian judiciary needs now. If we can have 10 of his type in the judiciary, change will certainly come to Nigeria. I reckon EFCC should take most of their cases before this man. Starting with the deposed bank thieves chiefs.

He sent Bode George to Kirikiri and now this.

Since 2008? This goes to show that justice delayed is definitely not justice denied, but how will a common constable pay 10mil?

The sum should have been awarded against the Nigerian police Force instead of the constable as he was on duty on behalf of the Force.

That means useing tax payers money or another victim of police harrasment 2 settle a crime commited by foolish constable who had the previlage of getting a job,an opportunity 2 serve his nation. Instead he was using d tax payers uniform and gun 2 abuse the right of his fellow country man. Pls let no one defend dis bastard by saying their condition of service and d salary blah blah. Didn't they knw b4 they enlist in the NPF? Come and how people rush 2 enlist some pay as high as N70,000 just get addmision in2 police college. Abeg make the bastard sell him family pay the moni. Oloshi! (Long hish)

The Nigerian police continue to be a disgrace to humanity - shooting someone because the person refused to give you N20? Pathetic!

It's high time our Justices began to be reasonable and realistic in jury awards. Where does he expect the policeman to get 10 million? Same thing applies to the judge that says Rear Admiral Arogundade should pay N100million to the battered lady. N2 million should be okay in teh case of the Naval officer and something like N200,000 in the case of the police constable.

These sums are just too outrageous. We are not talking about Shell or Chevron here.

@Jarus

Though I understand your point, 200k is too small to treat gunshot wound. You need to see a victim to confirm this. The amount u spend treating gunshot wound depends on which part of the body the bullet hits.

In advance countries the various departments, Police, Hospital, or any other Government Department actually budget for compensation expenses which would be paid by the tax payer. Those 2 Judgments are against the Nigerian Navy and the Nigerian Police Force indirectly, although the letter of the Judgement says the Navy rating and the Police Constable the liability eventually ends up with their employers, of course we all know the Ratings and the Constable cannot pay the amount.

Year on Year the Bosses of such organisation are expected to review their compensation expenses, if it keeps on going up then it simply means nothing is being done to curb this horrible behaviour, in such circumstances the bosses of such organisation might end up losing their Jobs. The implication of such action would be that the bosses are not doing anything to curb this menace to society.

@ jarus
what amount is outragous? Ebe like sai u dey 9ja. Are u ignorant of 9ja police extra judicial killings, police harrasment of innocent ppl. I think if u or close one have been involve in 9ja police wahala u will not say d amount is outrageous. What amount can pay 4 a life or human dignity? Note, that amount is what they can easily get from another victim of police brutali ty. So if d constable can not pay let him go 2 jail. A lesson 4 others
