Buhari is serial defaulter of court orders. He's a moronic tyrant. I cant wait for 2019 to arrive so that he will be disgraced out of office.

But Buhari have unbriddled disdain for the courts and will not obey any pronouncement that does not feed into his plan.

No need to appeal the useless judgement. It has been settled after many cases that no court order c stop any govt agency from doing what the law that set it up to do.

When people want to mislead the unsuspecting public for their selfish gains, they peddle all manners of falsehood. An order of interim injunction is an ex-parte application(i.e only the party seeking it is in court, the other party(ies) is/are not in court) and it has a lifespan of seven days and is renewable for another seven days. So seeing that this order was given last year, it is my opinion that the order has elapsed despite no appeal against it as the period for it has long since elapsed. Please the Ekiti State government should stop giving a dog a bad name in order to hang it. They should do the needful legally and stop peddling deliberately misleading information.
N.B: I am not an APC or PDP member, I just felt I should contribute my own two cents to the ongoing debate. Thanks

Thats a nice way of putting it.

In other words, agencies of government under Buhari will not obey the ruling of the courts as long as it runs contrary to their plans.

A court order does not prevent EFCC from doing its statutory function! The people that filed that motion are bunch of jokers, that was why EFCC didn't deem it worthy of appeal.

What the people that got this court order would have done would be to first challenge the paragraph of the constitution that empowers EFCC to investigate and prosecute economic crimes and to arrest and detain those found culpable. The constitution of the Federal republic is supreme to any court order so this is an exercise in futility; getting a court order to prevent an agency from doing its statutory function which is embedded into the constitution is is dead-on-arrival; it does not even worth an appeal.

That Order being an Interim one and issued since last year, must have either elapsed or vacated

That said, APC has a track record of disobeying Court orders. They should learn how to respect Court Orders, if not the whole separation of powers and rule of law principle will be a mere charade ...

It is a shame to have tyrants in power who are this brainless.

Nobody is saying that Efcc shouldn't do their work but the timing is very wrong ,Fayose declares for president the next minute you go on clamping down on his cabinet members .

If they had a case of financial fraud against ekiti govt why wait till now? this is just too ridiculous and one wonders the type of drugs this people high on.

Fayose could have sourced his campaign funds from many other sources other than bail out funds ,yes after all bail out funds wasn't released just yesterday.

If the Efcc cannot obey a court of jurisdiction that is legally constituted by the Nigeria laws then this govt is a hoax.

Did the efcc give reason for the arrest? It it connected with the bailout funds? Is it connected with the funding of campaign? Did the efcc gives these indication?

How long have the efcc been carrying out investigation on the arrested man? Do you know? And of after concluding their investigation, and they see an opportunity to arrest him, can't they?

It's like telling a governor not to carry out his functions as enshrined in the constitution. It can't work.

A court can't tell EFCC not to carry out its constitutional duties.
When you run to court for protection or injunction, that means you have alot to hide.
Only the President & VP and governor & Vice has immunity not to be investigated nor arrested.
These nonsense court injunctions are alien to the constitution.

And these nonsense court injunction are too much. It's like the court injunctions are designed to protect even the top civil servant, giving them some formal of immunity

It is a settled law in Nigeria that no court can stop any govt agency from doing what it was set up by law to do. No court can stop EFCC from acting in any way that the law that set it up allow it allow it. So, when EFCC is ready, the appeal won't require many sittings to set aside aside t judgement

So you mean the EFCC can flaunt a Court Order albeit an INTERIM one, when the matter is LIS PENDIS?

Na wha oo!

PS!
I just saw that the order was given since 2016. Being interim in nature, it must have since been vacated....

The OP has just exhibited his crass ignorance in respect of this Ruling.

The Ruling published here is an INTERIM INJUNCTION and not a perpetual injunction. An Interim injunction is a temporary order that is made to terminate upon the occurence of another event as in the instant case UPON THE HEARING AND DETERMINATION OF A MOTION ON NOTICE. This is clearly spelt out in each of the heads of Ruling displayed by the OP.

A typical interim injunction hardly lasts longer than a month as it is attached to a subsequent action that terminates it. It is only a PERPETUAL INJUNCTION that does not expire and usually available in land matters, upon judgement.

All the clowns masturbating over this Ruling must have had their respective sense of judgement beclouded by ignorance, hatred and idiocy by association.

The ruling is written in English language and i expect ordinarily educated guys to understand it except those who are born with factory-fitted hatred embedded in their brains.

Shikena!!

Lol. EFCC will ignore this "court order". A court cannot order a bank not to reveal transaction information to the police. You cannot take away the constitutional duties of the EFCC and police. cheesy

How more biased can we get...?

All APC members are not corrupt, and once u are from the opposition party or posse a threat to ruling party you get arrested, irrespective of court restraining orders.

Govt accept all court orders that serve their interest and neglect any order that promotes personal liberty and innocent until proven guilty.

Impunity!!!

The back bone of democracy (rule of law) have been crushed to powders in this shameless Buhari Administration.

Please don't mind this bunch of jokers.
1. The said law that was promulgated by the "rubber stamp" Ekiti assembly was to serve as a hindrance to the smooth running of the EFCC act.
2. Despite the fact that its expressly stated in th constitution that any state law that contradicts with federal law is null and void, the judge still went ahead to give that fraudulent judgement.

And what's the procedure for evacuating an obnoxious court order?

Arresting the parties involved?

Why get court order if your hands are clean and no skeleton in your cupboard? They invited EFCC by getting a restraining order that made searchlight to be beamed on their clandestine activities. Remember, EFCC will send them to the same court that gave the same order.

A responsible government that is ready to fight corruption head-on cannot work with our judiciary, otherwise he will not prosecute a single case successfully in 4 years. Our judiciary are anti corruption fight saboteurs.

An order of interim injunction heard on an exparte motion has a lifespan of 7days, thereafter it is of no effect again. The EFCC is right to arrest them. The Supreme Court has also ruled that no court of law should grant an injunction restraining public officers from carrying out their duties under the law in Nigeria
