It's a mark of administrative and political rascality for the president to keep renominating the same candidate for confirmation after he has been rejected by the Senate based on security report.
Insincerity is when Buhari wants us to believe that Magu is the only Nigerian out of 180million that can serve as eccentric chair.

You rightfully quoted the Senate's constitutional obligation to confirm or reject executive nominations, but not the executive powers and prerogative to nominate and keep nominating any candidate they desire including Magu.


There is no law under the Nigerian constitution that says the executive cannot keep nominating and sending the same candidate for confirmation.


The Senate is free to keep rejecting Magu, it is their choice per the constitution, but they can not prevent the executive from nominating the same Magu over and over and over and over again.


Bottomline, this ruling means a lot to the Senate, but it means nothing to the President of Nigeria and it doesn't say and can never say the President of Nigeria can not renominate the same candidate.


Now, the Senate should never be allowed to approve heads of agencies like EFCC especially considering the fact that many members of the Senate are under investigation by the same EFCC/Magu, even the Senate president himself.

It's like asking the armed robber to pick and chose his own favorite prosecutor and deciding Judge. It's called conflict of interest.

The Senate by the deciding to place an embargo on Executive nomination approval is unconstitutional and illegal blackmail, they have to do their job which is to confirm or reject nominees.

The President per his powers and equal powers regarding separation of powers has the upper hand and al the Senate can do is to keep saving face with meaningless court judgments and tantrums.

The Nigerian Senate in it's present form is rubbish, unfocused, corrupt, materialistic, self-serving and incompetent.

In fact, he is toying with impeachment. He would be impeached and nothing will happen.

Let him keep appointing magu, and Senate will keep rejecting him. It will become illegal for him to act as the chairman of the EFCC.

Shows how little you know about developed countries and democracies simply because in the developed democracies and in the USA where we copied democracy from, public officials under criminal investigation and on criminal trial are forced to step down, they don't get to remain in office or allowed to participate in proceedings where they get to deliberate on and approve the same nominee prosecuting them and in charge of their ongoing criminal trials.

It's not done, only in Nigeria accused public officials on trial remain in office, not in America where such people are forced out even based on mare allegations of wrong doing.


2. There is no law within the Nigerian constitution that says the president can not re appoint the same nominee based on his constitutional rights and preference for the job and if there is, why is the senate unable to stop the president from doing so? They can not because it's his job to nominate and if preferred, re nominate the same person. That's his job.


3. There is an obvious gap in the constitution that the same ignorant and incompetent lawmakers must attend to if they really are concerned.


4. They are lawmakers and apart from their job per approving executive nominees, they also pass bills, make and amend laws.

5. Since they are allowed by the Nigerian constitution to make and amend laws, why are they not amending the laws or inserting clear stipulations that says the president can not and must not renominate the same nominees?

6. So, instead of going back and forth with the president, why are they not doing their job by amending the constitution to clear up the constitutional ambiguity and stop the president from renominating the same candidate?

Are they not law makers again?

. so Magu is fighting corruption? I have never seen a corrupt person like Magu and just in case u r doubting me, ask those efcc cadets that r undergoing training at NDA Kaduna. some cadets were wrongfully dismissed and replaced based on fake medical test after undergoing training for months. Is there any corruption more than that??

The fact that any nominee was rejected doesn't mean or stops the president from renominating the same nominee, it's not against the law or against the constitution of Nigeria and if it does, show me the part of the constitution that says the president can not.

The president is granted the sole authority and rights to nominate and as long as the constitution doesn't stop him from renominating and the useless senate doesn't amend the law to prevent renomination, the president remains within his rights to renominate.


On the question of whether Saraki should step down, perhaps you should show me where the constitution says anybody who has not been found guilty by the court should be found guilty by mere allegation. And now that he is being cleared by the court, you still want him to step down?

In the same developed democracies you yourself inserted into the conversation, they don't wait for any guilty verdict before forcing their public officials out of office, it's not a legal issue, it's a morality and high professional standards issue.

Senator Al Franken was forced out of office by his own party based on just allegation, not any kind of guilty verdict.


In the same developed democracies you brought up, you can not deliberate or participate in matters relating to the confirmation proceedings of the same candidates heading the institutions you have pending cases under. You have to at least recuse and excuse yourself, you can not participate.


If you can not rise up to the same standard, morally and socially in developed democracies, then never make references or insert any logic regarding the same developed democracies because you as a person and based on your ignorant and warped understanding per developed democracies, you are mentally, morally and socially below their standards.

Senior Lawyers, Itse Sagay and Festus Keyamo have weighed in on a recent court judgment regarding Ibrahim Magu's status as the acting Chairman of the Economic and Financial Crimes Commission(EFCC).

On Thursday, a federal high court in Abuja presided over by Justice T. Tsoho ruled that the Nigerian Senate acted in accordance with the law when it screened and rejected Ibrahim Magu's nomination as chairman of the EFCC.

Reacting to the development, Keyamo said; “The fact that the law has not circumscribed the amount of time or the time period that someone can act as the head of an agency, it would mean therefore that I see no legal problem at all in Ibrahim Magu continuing to act as the Chairman of the Economic and Financial Crimes Commission, there is no legal impediment at all.”

Sagay, who is also the chairman of PACAC, said; "I don’t expect that the judgment will have an effect on Ibrahim Magu’s status as Acting EFCC Chairman. I don’t expect that there’s anything externally that is going to affect Magu’s position.

"I don’t know whether the judge considered Section 171 of the Constitution which even allows the President to appoint heads of agencies like Magu’s agency without any reference to the Senate. That is already there, so I don’t know what was brought to the court’s attention. When we see the full judgment we will be able to express our opinion,".
