Hello, i just saw this thread. Im a lawyer, called to bar and finished NYSC. Im looking for a Job at the moment. Im not good at litigation but Im good at research, reporting cases, drafting and writing. I will really appreciate some help. thank you.

My friend a Nigerian got a lease for a shop in Benin Republic for 10yrs that was in 1987 where he started business, in 1997 the owner asked him to buy the place but because he didnt have money he asked for another lease, this time for 17years, This year 2010, the owner of the land sold the land to a different person without the consent of my friend,he came to my friend to tell him he wanted to reimburse him for the outstanding 3years. Meanwhile the new land owner have started construction around the shop and even wants to break down the place, i asked my friend to file for an injunction for the maintime to keep the construction at bay, but the real problem is that my freind intends to buy that place now at the end of this lease cos he's been there for such a long time and people now associate that vicinity to him. Is there anything he can do?

@ linda lee .The owner gave ur friend the option to purchase before he sold it out.At best the injunction can stop them from tampering with his/her property.But all the new owner can do is to wait for the lease to expire if ur friend refuses his offer to buy out the three years left on the lease .
My advice is to collect the the balance on the lease and shop for another area to build his/her business because at the expiraton of the lease ur friend would still need to start afresh.So why not accept the offer .
Alternatively,ask the owner to give him one more year,tn he can run the old business along with the new one he wud set up then at the end of the the one year he would have created an image for the new business location.

I am one of you with considerable experience in the area of corporate governance having been an inhouse counsel in a multinational corp for many years.
I read a post that the practice of intellectual property in the country is almost not in existence.This is not exactly so.Most of the global brands being sold in the markerts here are registered.However most of the firms who are into the practice operate a closed shop.same can be said of other ares like admiralty .
As is the case with MNCs they will not expose their intellectual property if their is no protection
Legal practice in Nigeria has come to the stage where specialisation is now required.However very little of that is going on .we have practitioners who are into everything including estate agency.This definitely is not the way foward

This is a great forum.. I keep wondering why learned fellows like us take the back seat when educated peeps are at the fore on topical issues affecting the socio-political as well as economic well being of our dear nation.. The profession comes with its perks no doubt.. But we can all create time and contribute positively here..to the benefit of both aspiring, new wigs and veterans of the profession.. No one is a reservoir of knowledge.. Thank u
