The attempt by lawmakers to legislate the order of election is not entirely new having travelled this route before in 2002. That year, the legislators attempted a similar amendment of the Electoral Act with the enactment of Section 15 of the Electoral Act 2002, in relation to fixing the order of elections into the offices of the President, National Assembly along with governors and state houses of assembly elections. At that time, the incumbent President withheld assent but was vetoed by the lawmakers. Their action was further challenged by the INEC in the case of NASS vs The President at the Federal High Court. The court subsequently struck down the said provision as unconstitutional and inconsistent with the provisions of sections 76, 116, 132 and 178 all of which stipulated that “Elections…. shall be held on a date to be appointed by the Independent National Electoral Commission”. Thereafter, the National Assembly appealed against the judgment at the Court of Appeal and again in a unanimous judgment, the court as per Justice Oguntade. (J.C.A) who delivered the leading judgment affirmed the decision of the lower court and even went further to state that, but for the fact of the wide disruption of our national life that may ensue given that the Act was already being used for the 2003 election, it would have nullified the entire Electoral Act but however declared the provision of section 15 of the 2002 Electoral Act unconstitutional, given the provisions of sections 76, 116, 132 and 178 as they were in the textual form at that time.

I dont think Saraki is fulfiling any condition to be accepted by PDP. He is a big fish and will be accepted anyday. It could be his own way of getting back at the executive for all the assault on him using the CCB. But on the other hand, whats the fuse of the presidential election coming first or last if our people are honest to themselves?

Well, even if Buhari vetoes the bill, the NASS would override his veto if a 2/3 majority vote so.

Realistically, it’s only a court that can quash the bill (or soon to be law).

Realistically, it’s only a court that can quash the bill (or soon to be law).

It is not easy to override the veto of the President... A lot of things come into play...Even Saraki may not contain it..

The functions of INEC as contained in Section 15, Part 1 of the Third Schedule of the 1999 Constitution (As Amended) and Section 2 of the Electoral Act 2010 (As Amended) include the following:
 Organise, undertake and supervise all elections to the offices of the President and Vice-President, the Governor and Deputy Governor of a State, and to the membership of the Senate, the House of Representatives and the House of Assembly of each state of the federation;organize.

To organise means to:

arrange systematically; order.
organize lessons in a planned way"
Other synonyms are:put in order, order, arrange, sort, sort out, assemble,  straight, group, dispose, classify,collocate, categorize, catalogue, codify, tabulate, compile, systematize, systemize, regulate, regiment,standardize, structure, shape,.the bill is dead on arrival.

Senators, on Wednesday, were divided over the reordered sequence of the 2019 General Elections.

Recall that the reordered sequence puts the presidential election last.

The Independent National Electoral Commission had, before now, put the presidential election among the first elections to be conducted in February 2019.

On Wednesday, the report on the election sequence was submitted for consideration of the Senate by the Chairman of the Senate Committee on INEC, Suleiman Nazif.

After the presentation of the report, Senate President Abubakar Bukola Saraki did not allow senators to make contributions to the amendment, a development that led to series of Points of Orders on the floor of the Red Chamber.

Senators such as Kabiru Gaya, Abdulahi Adamu and Adamu Ailero, had raised points of orders on the passage of the bill.

But the Senate President ruled the lawmakers out of order and when some lawmakers observed the position of their leadership on the matter, they left the chamber,

Fifty-nine of them were to later address the Senate Press Corps, insisting on their opposition to the reordering of the elections.

The National Assembly is progressing in error.
why?
Instead of changing the order of election which will not see the light of day at the supreme court, they should first remove appointment of INEC Chairman from d control of the executive and add the clause the powers of the NA to change the order of election or override the order of that of INEC.

In 2015,the ruling favoured the presidency i guess.the judiciary can also rule in favour of the executive since its 50/50.the constitution gives inec the power tl fix timetables not nass.nass can as we fix and conduct election.
