Meanwhile, the Action Congress presidential candidate, Alhaji Atiku Abubakar, on Friday filed contempt proceedings against the chairman of the Independent National Electoral commission, Prof. Maurice Iwu, and the agency’s Head, Legal Service, Osaze Uzzi.

A two-page statement issued by the Atiku Campaign Organisation said the “Notice of Consequence of Disobedience to Order of Court” otherwise known as Form 48 was served on Iwu and Uzzi, “following their refusal to obey the direction contained in an order of the Federal High Court, Abuja, to the effect that INEC does not have the power to disqualify candidates for the 2007 elections.”

Also stated: Also the AC on Friday raised the alarm that the Peoples Democratic Party and INEC were pressurising the Nigerian Security Printing and Minting Company to omit Abubakar’s name and photograph from the ballot papers to be used for the poll. INEC awarded the contract for the printing of the ballot papers for the April elections to the NSPMC.

Addressing journalists in Abuja, the AC’s National Chairman, Chief Bisi Akande, said the PDP and INEC had in the last two days being pressurising the printing company not to put Abubakar on the ballot papers.

He said the NSPMC contacted the AC few days after it won the contract asking the party to supply it with Abubakar’s photograph as well as those of the governorship candidates of the party. Akande said information available to the party had shown that PDP and INEC officials had two days ago asked the company to leave the vice-president’s photograph and the AC’s symbol out of the ballot papers it was printing.

Asked to provide evidence of the allegation, he said, “We are a political party and we have a way of getting information. We know what we are talking about.”

An apparently angry Akande vowed that, “any ballot paper printed without our party symbol will not be valid. It will be easy to nullify any election for which it is used. The election will not be credible and any compromised election will not hold in this country.”

On the former Anambra State Governor, Chief Chris Ngige, and other candidates of the AC disqualified by INEC, Akande said his party would return to the drawing board and thereafter react appropriately to the development.

When asked whether the vice-president’s name was on the ballot papers, INEC’s commissioner in charge of Publicity, Mohammed Jumare, said on the telephone, “Can’t they (AC) wait for the time we are going to release the names? Why are they speculating?”grin

Iwu, who spoke in Abuja after releasing the names of the governorship candidates and those for state Houses of Assembly, said: “The commission has maintained that it will not disqualify any candidate. The commission has also maintained consistently that it is the constitution or the court that can disqualify any candidate. The judgement in question, we have received. The plaintiff asked for six reliefs; only one was granted with conditions.”
“And one of the conditions was that the court reaffirmed the power of the commission to verify the candidates and the documents submitted to it. I know that the media did not carry that, but it was there.”
“I can give you copies of the ruling. I am not talking about speculations. I am talking about what the court said. And the court said the defendant has no powers to disqualify candidates. We have never claimed that power. And the same court went to say that there is no way that INEC cannot be allowed to verify candidates,” Iwu stated.
He stated that, "The issue here is to seek further interpretation of the court. And I think that our lawyers are doing that. The court also made the point about section 32(5) of the Electoral Act which talks more of when people send us false information. And our lawyers are trying to seek for the interpretation or clarity as to what happens when somebody send us correct information. And the same person is not eligible.
"For example, if somebody is not a Nigerian. The person is sending us the correct information, but he is not eligible. We don’t make the rules, we don’t disqualify anybody.”

Atiku thinks Iwu will join him in filling up blank spaces on the constitution with un-existent laws that suit him.

A Judge rules that INEC has no powers to disqualify candidates but INEC has powers to screen or verify candidates. In the case Atiku prayed for 6 pronouncements he was granted only one which is that "INEC had no powers to disqualify anyone". A position which has always been maintained by INEC itself. Then INEC goes on to source the interpretation of that Judgement, Atiku runs to the media shouting he has won again and INEC is disobeying court orders. Does he think he can bully the INEC chairman

Atiku's victory on this case only exists in the media. He has won nothing.

if anyone is saying never let the person tell us his reason(S).
accepted here is that atiku is corrupt but what about the others.
are we talking about what is or what is ought to be?
is atiku the only corrupt politician or is he more corrupt than others.
if we want to fight corruption or if this government is fighting corruption will Toney Annenih hold back 300 billion naira mearnt for Lagos - Benin express road and still be the chairman board of trustee of pdp? will Chris uba be a member of the same board after destroying anambra for years ? will adedibu be a statesman after all his problemss in oyo and making his house the second inec office where inec machines are kept for rigging purposes?
how come atiku is been persecuted by all and sundre for a mear allegation while Andy Uba who has a confirmed case of money laundary which involved nigerian presidential jet is still an approved candidate for pdp.
let us face reality and allow the thieves to continue their reigns because we are not ready yet.
selected justice is worst than do as u like society.
the biggest criminals are in aso rock and we sing their praises and persecute the street criminals.
obj is the most corrupt thing nigeria has ever seen and he has been working and sharing nigeria's money with atiku till he disagree with his excessivenes.
let them put him in the election till when God's time comes we will know who is who?
obj has finally dropped the country for campaigns as that is more important than nigeria itself.
his fears lie on the possibilities of another candidate been the next president because nigerian will hate him with passion.
if their is anything obj need now is cover which he believes yar adua will provide him.
