Sen. Dino Melaye, representing Kogi West in the Senate, has filed an appeal at the Supreme Court, seeking an order restraining the INEC from proceeding with his recall from the Senate.

Melaye’s appeal is sequel to a judgment delivered by the Court of Appeal on March 16, which gave INEC the go ahead to continue with the recall.

In a notice of appeal filed by his Counsel, Mr Mike Ozekome, (SAN), Melaye wanted an order of perpetual injunction restraining INEC from commencing or further continuing with his recall or acting on the purported petition.

Melaye also asked the apex court to set aside the March 16 judgment of the Court of Appeal.

He further sought an order declaring the petition purportedly presented to INEC by some purported constituents for his recall as illegal, unlawful, wrongful, unconstitutional, invalid, null and void and of no effect.

Melaye, in addition prayed for a declaration that the recall purportedly initiated against him by INEC and on the basis of the petition was illegal since it commenced on the basis of an invalid petition.

In addition, Melaye asked the apex court to declare that the 90 days period as provided for under Section 69(b) of the 1999 Constitution as amended had elapsed.

According to him, having elapsed, INEC can no longer proceed on the basis of the purported petition.

He said the Court of Appeal erred in law ‎when it held that it was not for the court to verify the signature on the petition.

He said the court held that it was the duty of INEC, by reason of which the court failed to invalidate the petition presented to INEC.

It would be recalled that the appellate court had in its judgment delivered by Justice Tunde Awotoye, leading two other justices, dismissed all the grounds of appeal filed by Melaye.

The appellate court held that the 90 days stipulated by the constitution within which a recall process would take place had no time limitation as it could be extended.

Justice Nnamdi Dimgba of the Federal High Court, Abuja, had on Sept. 11, 2017 dismissed a suit filed by Melaye, seeking to stop INEC from initiating his recall from the National Assembly.

Dimgba held that Melaye’s complaints were hasty, premature and presumptuous and therefore ordered the INEC to go ahead with its planned verification.

If I am also collecting 13.5 million naira monthly asides my 700 thousand naira monthly salary, I won't want to leave the senate.

By the time DJ Melaye finish at the Supreme Court,his tenure will be over already. After all, it remains less than a year to elections

It was the same Malaye that connived with others to rob James Faleke of his legitimate mandate and install Yahaya Bello in the process simply because he needed to keep Tinubu out of Kogi state. He declared that "whoever fights Bello will be crushed because he is fighting God". Now the monster has come back to haunt him...

I hope the Supreme Court teaches this loud-mouthed thug a lesson by not only throwing out his appeal, but also penalizing Melaye for trying to run out the clock on his mandate through delaying tactics, by forcing him to repay in full all salary and allowances he's been collecting from the first moment his recall should have taken place. It is important that Melaye's recall be turned into an object lesson for Nigeria's political class, so they start to understand that it is their electorates they are ultimately answerable to, not some godfather or other with whom they can collaborate on scheming in the NASS.

I know the bitter truth today however.
The money OBJ spent was spent around December 2006 and OBJ left office in May 2017. How then could the monies have translated to electricity for you and I? That 16 million dollars laid the foundation of the little electricity supply Nigeria enjoys today. Some of the funds went to Egbin Power Station in Lagos and Omotosho Power Station in Ondo state amongst others spread across the country.

Like you, I had always thought OBJ embezzled the money but alas,it wasn't so. A man who hate OBJ with passion was even gracious to tell me about this. Information is power.

It may eventually be that the motive behind the entire drama is not to recall the Senator, but to destabilize him and his political machineries.

To a large extent, Dino already has his plate filled and may not be thinking about 2019 now

Whatever that person told you isn't true. There is a comprehensive report of how money was squandered during the 8 years of obj and almost nothing came out of it. I personally know several people who served in the committee of power in the house of rep and the fortune they made.
I suggest you should go and research and find out things by yourself.
