Senator (Pharm.) Matthew A. Urhoghide (FPSN, FNAPharm.), Chairman, Senate Public Accounts Committee today April 26, 2018 moved a motion on the floor of the Senate of Federal Republic of Nigeria for the impeachment of President Mohammadu Buhari GCFR over the president’s unconstitutional spending of money from the Consolidated Revenue Fund without the approval of the Senate. Nigerians across all divides hail this as a move towards ensuring proper separation of powers and curtailing extant impunity, chaos, usurping of roles and fiscal irresponsibility. MOTION
Violation of the Constitution of the Federal Republic of Nigeria 1999 as Amended

The Senate:

Notes that following the disclosure by the President and Commander-in-Chief of the Federal Republic of Nigeria, President Mohammadu Buhari GCFR in the letter transmitted to and read on the floor of the Senate on the 25th of April 2018 by the President of Senate, Distinguished Senator Bukola Saraki CON, to the effect that he, the President of Nigeria has paid to the Government of the United States of America the sum of $496,374,476 for the purchase of Tucano Aircraft for use in Nigeria without following the due process of seeking the constitutional approval of the National Assembly to appropriate such expenditure from the Consolidated Revenue Fund.

Recognizes that this action by Mr. President violates Section 80, sub-sections (1), (2), (3) & (4) of the Constitution of the Federal Republic of Nigeria 1999 as Amended.

Further observes that whereas Senators as elected members of the National Assembly having subscribed to the Oath of Allegiance and the oath to observe, uphold and defend all the provisions of the Constitution of Nigeria at all times, agree that this grievous infraction is a gross violation of that sacrosanct document which the Constitution of the Federal Republic of Nigeria is.

Worried that such unilateral action of Mr. President sets a dangerous and chaotic precedence because it undermines the principles of Separation of Powers and Accountability necessary for the good and proper governance of the nation.

Accordingly resolves as follows:
1. That the President of the Senate of the Federal Republic of Nigeria should immediately commence impeachment processes against the President and Commander-in-Chief of the Federal Republic of Nigeria as provided in Section 143 of the Nigeria Constitution of 1999 as Amended.

2. That the mandatory signatures of two-third majority of members of the National Assembly that would give effect to this process of impeachment to commence having been voluntarily supplied by members are hereby attached.
