A solid construction contract represents one of the basic steps toward the success of your building project. This contract is a legal agreement between the client and the contractor.
Contracts are written documents that define the roles, responsibilities, work parameters, and are legally-binding on all involved parties (i.e. Owner and Contractor).
On a fully-designed construction project, the following documents should be included:
1. ARTICLE OF AGREEMENT.
This is the main document which other documents are attached or reference. It defines the agreement between the contractor and the client. The responsibilities of each parties in the construction process are clearly defined in the Article of Agreement.
2. WORKING DRAWINGS.
This contract document graphically shows the scope, extent and character of the work to be performed. The drawings can be architectural, statical, electrical, landscape or mechanical. This document must include adequate graphical information for the entire project that is being contracted.
3. BILLS OF QUANTITIES.
This document contains the list of diverse trades and materials that will form part of the construction. It includes quantity and price for each work during and after bidding phase. After bidding phase, it will be an attachment of the contact phase.
4. SPECIAL CONDITIONS.
This specifies certain conditions and clauses that pertain to each project. It describes specific requirements and instructions on how to perform the work.
5. SCHEDULES OF WORK.
The schedule of work is an important document for both parties. It shows site delivery date, start and finish milestones, project duration and other useful information.
To ensure a successful contract, these documents should be draw in all simplicity and clarity. Both client and contractor should endorse the contract by witnessed signatures prior to commencement of work.
The purpose of these documents is to establish a way to resolve issues in case of any legal action. It also serves as a legal guide that will be used to solve potential conflicts in the case of any legal action.
