The Court of Appeal Sitting in Port Harcourt has dismissed all appeals brought before it by Tonye Cole and Ojukaye & Ors.

The appeals are as follows;

1) Appeal 461 which is the substantive appeal against the Judgement of the Rivers High Court delivered on the 10th, October, 2018 was also struck out. The court held that being a pre-election matter it was filed out of time and it is statued barred.

2) The application for joinder by Tonye Cole & Ojukaye was also dismissed.

In a judgement delivered by the Chairman of the panel, Justice. Abubakar Daati Yayaha stated that the appeal lacked competence in its entirety and thereby struck out.

The law herein is to the effect that only the judgement of the Rivers High Court delivered by Hon. Justice. Chiwendu Nwogu on the 10th, October, 2018 is potent and subsisting.

The legal implication of the entire story is that as it stands today,River APC do not have candidates for Governorship,Senatorial, House of Representatives and House of Assembly for the 2019 election.
