Senate President, Dr. Abubakar Bukola Saraki has advised the Federal Government to ensure that its plans to put on trial the nation’s chief judicial officer, Hon. Justice Walter Onnoghen, follows due process.

Saraki in a statement in Ilorin on Sunday and made available to Naija Politico noted that he believes that if the Government truly has genuine reason to put the incumbent CJN on trial, it should ensure that every step in the process is transparent.

He stressed that the process should be that as clearly stipulated by the law, warning that the government must ensure that the planned trial does not cause chaos in the judicial system.

“A situation where the petition which triggered the trial was submitted to the Code of Conduct Bureau (CCB) on Wednesday January 8 and by January 10 on Friday, the Chief Justice was presented with it for his reply only for the charges to be drafted that same day and filed in the Code of Conduct Tribunal (CCT), all this taking place within three days and commencement of trial fixed for Monday, January 14, already indicate unnecessary haste and short-circuiting of the process of fair hearing.

“It is important for the government and members of the public to know that as somebody who has traveled this route before, we should refrain from any media trial and political players should avoid abusing the judicial process in order to achieve what they could not get through normal political contests.

“Every body who is being tried should be presumed innocent until proven guilty. That is the underlining principle of our justice system.

“The proposed trial of the CJN has once again opened up the debate on the transparency and neutrality of the fight against corruption,” he said.

Saraki expressed grave worry at the haste with which the trial was put up, stressing that only three working days from petition to trial gives room for great concerns.

He stressed that the haste is more worrisome especially considering that there are other pending cases where the individuals involved have been indicted for months and they were yet to be tried or scheduled for trial.

While noting that the anti-corruption fight has become a case of a separate rule for the people close to the executive branch and another set of rules for the rest of Nigerians, the Senate President stated that the fight has been compromised and politicized.

“All these subjective actions politicize the anti-graft fight. They weaken national institutions. They send wrong signals.

“The CJN is not above the law but his trial puts the entire judicial system on trial. It sends a signal to the entire world about our judiciary. It has implications for the confidence of local and foreign investors about the system of adjudication over disputes in our country.

“Thus, the matter should be handled with care, demonstrating intense transparency and strict adherence to due process,” he said.

He added that the entire country and the international community will be watching closely every step in this trial.

No body is actually saying he doesn't have a case to answer. All of them are crying that the process is to swift in filling charges against the CJN. haven't we been looking for a swift justice system? Why are they crying now?

Some people are saying it doesn't follow due process because NJC have to do their investigations first.
The CJN is the chairman of NJC followed by the most senior judge in the Supreme Court as the vice chairman. He will have to step aside first for NJC to do their investigations. He can't preside over a matter to which he is a party that will be tantamount to been a judge in his own case.
In advanced country he would have resigned since.

There are three Arms of Govt: The Executive, Legislature and Judiciary. The President heads the Executive, Senate President heads the Legislature and Chief Justice heads the Judiciary. And there is checks/balances. All we ask for is due process. 2 days of petition isn’t enough to prosecute such an office holder.

Buharists are supporting the prosecution of the CJN with everything. If by tomorrow, Buhari backtracks they will hail him as a reformed democrat. Olodo President and olodo disciples.

CJN Onnoghen will retire, but only after the dullard attends the Presidential debates.

After coup on the Legislature, its now the turn of the Judiciary. When it gets to the fourth arm, the people, there will be no legislature or Judiciary to save the day.

That itself is a banana republic, which has always been the dullards obsession, others call it a Sharia republic.

Buhari is just wasting our time. All these drama in few months to the election. By this time last election, Buhari has been to 14 states with his campaign team but now, he's no more interested in the voters. He is now interested in who counts votes and declare winners. ... Amina Zakari & Onoghen saga has taught us this. I pity those wanting to see him on that debate platform... I told u he his no longer interested in the voters!

This country is finished, even saraki us talking of due process which he knows will surely be frustrated at the end .

People have been sentenced to prison for committing lesser crime by the same onnoghen. shocked

I'm expecting PDP to tell him to resign the way they said to Adeosun so he can face his charges very well but for where, politicizing everything is all they're good at.

Onnoghen’s arraignment was sequel to a petition filed by a civil society group, Anti-Corruption and Research Based Data Initiative (ARDI), accusing the CJN of false asset declaration and other sundry allegations.

He is also being accused of maintaining Domiciliary Accounts which comprised Dollar Account, Pound Sterling Account and Euro Account which were alleged to be contrary to relevant laws, especially for public office holders.

It was also learnt that the FG in addition plan to file a motion on notice praying the tribunal to order the CJN to vacate office and recuse himself from any aspect of the case as chairman of the National Judicial Council so as to prevent alleged interference in his arraignment and trial.

We hope that the right judgement be delivered at the end of it all.
A better Nigeria is all we want.

A swift justice that is lopsided? Haba! No naa....have they tried babachir? Has he been indicted?

And more so, there is a due process the executive is failing to follow....The legal luminaries are geared to bring it out to bear!

Unfortunately, justice is not swift and its for a good reason. If it was swift then it means people are already guilty before proven innocent. Is it not ironical we get swift justice on the chief JUSTICE but a slow one on for Babachir.

The matter is a very simple one...

Ononghen should reach agreement to deliver favourable judgement to the APC in the Osun and Ekiti election petitions, and he will be a free man.

The type of swift justice system Babachir lawal enjoyed abi? Where is conscience in Buhari 's government pls. They are taking that guy out because he wont play along. Elections will be rigged, case will go as far as supreme court, they wanted their man there to finish the job. Period.
