Even though the interpretation acts gives the president the power to suspend the CJN, PMB acted based on a very clear order of the CCT. The president cannot refuse to obey a valid court order. Onnoghen should go to court to challenge the order if he’s aggrieved.

Which court? I am sure he will be afraid too. He wouldn't have access to slush funds to bribe is colleagues.

It is so sad, to see how some Nigerian youth think, what PMB did is what a good leader should do, the former CJN even admitted that he forgot to declare his assest and a whopping money of $3m . he was suspended and if he prove to the court that he is innocent. he will definitely return to office.

probably they didn't know about his writting statement, acknowledging his crime. they also don't know that in Nigeria law, anyone that is vested with power by law to appoint someone, has also by implication, vested with power to suspend the same person. therefore, by admitting to forget(which is not an excuse before the court of law) to declare his full assets as required, the CJN has indirectly writing to the president, given him a valid reason why he should as a matter of urgency, suspend him.

Lol this is the same constitutional tappings the corrupt judge made. It's fully legal what buhari did. He maintained the boundaries of the law.

If I may repeat, the Code of Conduct Tribunal has been established with the exclusive jurisdiction to deal with all violations contravening any of the provisions of the Code as per paragraph 15(1). This provision has expressly ousted the powers of ordinary regular courts in respect of such violations.

“The Tribunal to the exclusion of other courts is also empowered to impose any punishments as specified under sub-paragraphs (2) (a), (b) & (c) of paragraph 18 as provided in sub-paragraphs 3 and 4 of paragraph 18 while appeals shall lie as of right from such decisions to the Court of Appeal.

The real important question to ask at this stage is what is the consequences of the violation of the aforesaid paragraphs of the 5th Schedule to the 1999 Constitution?



“The answer to the above question is to be found in Paragraph 12 of the said Part 1 of the 5th Schedule which enacts as follows: -‘Any allegation that a public officer has committed a breach of provisions of this code shall be made to the Code of Conduct Bureau.’

“It is my considered view that the above provision is very clear and unambiguous. It provides a remedy in the event of any alleged breach of the provisions. The remedy lies with the Code of Conduct Bureau which has been clothed with the requisite jurisdiction to handle such matters.”

There is no provision for suspension in the constitution. What was stated was removal. U can't manufacture law by your self. There is a process to that.


There is no limitation placed on the president when it comes to a suspension. The only limitation is for a removal.

Thus Mr President obeyed the constitution by not removing but by suspending.

The constitution supports his action especially when the CJN himself has confessed to his " crime of omission ".

He cannot be a judge in his own case.

Modath you need to understand that their reasons for suspending campaigns are not because CJN was accused(if you noticed they have been silent about it since),but because the president has now thrown caution to the wind. If the CJN is guilty, let the process which brought him buhari determine that.
Buhari has a penchant for acting regardless of the law, constitution or due process, but only implements it when it suits his purpose of fishing culprits.


The basic truth is that PDP is looking for a time out which is just not available. They are at their wits end...

1) the fall out of the primaries ... Atiku overspent way beyond projections. so no floating funds. Even wells dry up at a stage.

2) defeated contestants are waiting for funds from Atiku which is just not coming. Atiku may have "zipped" his purse as the impending defeat is clear.

3) even if the funds come. they will cover their losses and what remains will not have the desired "trickle down " effect to buy votes. Kwankwaso is asking for about one billion or more

4) defeated contestants ,still "stunned", are are taking too long to shake off or are bearing grudges and are battling to keep their local "turfs" from a rampaging APC and other fringe parties that are taking the toga of " independent candidates.

5) Kwankwaso Makarfi, Lamido and Wike, Tambuwal & co cannot gather steam again, neither can Saraki.

6) Buhari has taken the wind out of their sails by this suspension to deny them the chance to avccuse him.of condoning alleged corruption . To make matters worse Onogen has accepted tgat he "forgot" to make declarations, wirh more revelations coming.

This goalpost cannot be shifted.

It appears PDP is just going through the motions but this election might be a loss.

This trash coming from someone I thought should know. Supposing your assertions are right, has Buhari adhered to the rule of law in removing the CJN? You don't know that the law needs to look at all sides of the issue before passing a justiceable verdict. If things are done with such arbitrariness, Buhari should have resigned when he was accused of not having WAEC certificate, but he defended himself in both the law courts and courts of public opinion before he was a able to procure one. I am so ashamed of your beclouded reasoning.

It is most unfortunate that you allow partisan sympathies to becloud your sense of reasoning. Very sad. This action may have consequences no one can predict now.
History shows that all the great conflicts and conflagrations which consumed countries and societies started with little incidents like this. The Nigerian Civil War in which millions perished started “like play, like play” as they say on the streets.
What Buhari has done is a coup in that he has suspended the Constitution and usurped the powers of the two other arms of Government thus desecrating and violating the principle of separation of powers. He has usurped the powers of the Judiciary in removing a CJN (NJC) and the powers of the Legislature (2/3rds majority vote). The Constitution was framed in such a way that no one arm can interfere in the other arm without at least one of the other arms being involved for balance and to avoid treachery. That is why to remove the President, the other two arms are involved; to remove the CJN, the other two arms are involved.
Currently, there are several suits pending at the Federal High Court against Buhari over failure to include any proof of any qualification in his Nomination Form sent to INEC. Note: the issue is that he did not include any proof at all: no proof that he attended Primary school, secondary school, Military academies, Military courses, etc.; Nothing at all. So the argument is not about whether what he has is equivalent to school Certificate or not as people have been arguing all over the place because there is NOTHING to consider at all.
My real point however is: BY THIS PRECEDENT OF REMOVING CJN THROUGH EXPARTE ORDER, SHOULD ANY OF THESE COURTS HEARING BUHARI CERTIFICATE CASES ALSO SUSPEND HIM FROM OFFICE AND SWEAR IN THE VICE-PRESIDENT BY EXPARTE ORDER PENDING WHEN HIS CERTIFICATE CASE WILL BE CONCLUDED??
We are clapping for a big Monster rearing it’s ugly head because of politics. When this one succeeds, Senate President and House Speaker will also be removed through Exparte Order, Governors will be removed through Exparte Order and then we would have descended into full blown dictatorship;
It will be too late and Nigeria will burn.

It is like saying the president can sack the senate president. The judiciary and the legislature are independent arm of the govt. Buhari can not suspend CJN becus it is an independent body fully managed by the judicial commission. He can only remove after such recommendation by the council and national assembly.

There is an attack on the constitutional separation of powers. The judiciary has been ambushed and usurped by the executive. The opposition and the civil society have the obligation to rise up and resist the growing fascism.

Buhari supporters claims he has cult-like following in the North. He should be confident to rely on the supposed following instead of truncating democracy as he did in 1983. What a load of rubbish.
