Below is Mike Ozekhome ,SAN. Argument Supporting the suspension of Justice Ayo Salami President of the court of Appeal by Jonathan over allegations of corruption without any evidence or case against him in any court.

*”According to Section 11 of the Interpretation Act, Cap 123, Vol. 8, LFN, 2004, the President can suspend indefinitely but not remove without senate. And the President just exercised this”*

This was the law that Mike Ozekhome ,SAN deployed in his argument supporting Jonathan but today he is calling for breakdown of law & order.

So what has Changed?

Ozekhome is the worst lawyer I've ever seen. He advocates mainly for the criminals and uses money to buy judgements from justices like the former C(T)hief justice Onnoghen.

I agree absolutely with the informed legal opinion of Ozekhome. The constitution is silent on how a CJN can be suspended and the interpretation act gives the president the power to suspend the person he appoints. In effect, the constitution is not against the suspension of the CJN and there is no inconsistency between the two.

However, I will come back to delete this post after the election is over grin. I don’t want my case to be like that of Ozekhome whose hypocrisy is now a matter of national discuss grin. This is what happens when crooked lawyers give legal opinion based on political expediency. If previous PDP hadn’t illegally suspended Salami and Sanusi and vigorously defended their illegal action, the current government would have no precedence to rely on. Some of us shouted when Jonathan was perpetrating the illegality but they didn’t listen.


Mynd44 and lalasticlala, the legal opinion expressed by ozekhome in this video deserve to be on front page.

Ozekhome's postulations has finally given Buhari the precedence he can draw upon to back his suspension of the CJN...... grin grin grin. Besides, the law says he who seeks justice must come with clean hands...can we say the same for the Chief Justice of Bureau de change

It's a shame. Lawyers pride themselves on their ability to bend the law to get out of any situation believing that they have the exclusive right to do so as long as the same distorted law is not used on them.. A law so clear as day will be taken out of turn and degraded so much so that the innocent is denied justice. If this were to have affected any other person than the CJN, then the president would have been right and loopholes in the constitution will be sought to back him up. Instead, one of their own is now involved, so the president is wrong not minding the precedence that was set before now by the same legal body. It is just so confusing.
To continue with the same logic, assuming the suspended CJN was from the North, then this scenario would have been okay and in keeping with the constitution, but unfortunately, he is from the South, so again, the president is wrong and must be made to see the errors of his ways.
Most lawyers rarely care about the common man, they are only interested in whomsoever meets their needs more at the very moment and it always helps if the client has more power, and financial clout. A few are worth emulating and it is my prayer that they will be in the helm of affairs to protect us all

Because there were court cases already on the matter.
Moreover did Nigerians vote for more of the bad things that Jonathan did or for the better change promised by Buhari and APC

FG Will Not Reinstate Justice Salami – Minister Of Justice


The Attorney General of the Federation and Minister of Justice, Mohammed Adoke on Tuesday said that the Federal Government will not reinstate the suspended President of the court of appeal, Justice Ayo Salami.

The Minister disclosed this while responding to questions at a ministerial platform, a programme where cabinet ministers highlight their achievements in the last one year.

Mr Adoke, who recalled that the NJC had in last year August, forwarded a letter to President Goodluck Jonathan suspending Justice Salami at same time recommending his retirement, said that the Federal Government immediately approved his suspension and put on hold the issue of retirement since the suspended judge took the matter to court.

He said the President could however not act on the resolution to recall the suspended judge because a court process on the matter was also served on the government the same day the NJC sent the letter to reinstate him.

“As it is today, the matter is subjudice,” the Justice Minister said.

“The matter is in court and no responsible government will try to overreach the court.”

“This government will do the right thing as soon as the judiciary puts its acts together.”

Mr Adoke added that the same misconception that trailed Justice Salami’s case has been extended to James Ibori’s conviction in London with the condemnation of Nigerian judiciary by the “uninformed”.

“The fact that ibori was convicted there does not in any way discredit the Nigerian judiciary because they have used plea bargain in securing his conviction,” Mr Adoke said.

The Minister said that if the same plea bargain was applied here in Mr Ibori’s case Nigerians would have condemned it.

The NJC had on Wednesday reversed itself and approved the reinstatement of Justice Salami, in a decision that promises to bring to an end several months of bickering within the nation’s judiciary.

The Judicial Reform Committee headed by a former Chief Justice of Nigeria, Justice Muhammadu Uwais, constituted by Chief Justice of Nigeria, Dahiru Musdapher had absolved Justice Salami, who was suspended last August 18 by the same NJC, of any wrongdoing and recommended that he should be reinstated.

But the same NJC asked Jonathan to re instate Salami which he refused.
His refusal is not even based on any court order.
Sanusi was suspended by Jonathan without Senate approval nor any court judgement.
